CITY OF EVERETT SPECIAL PROVISIONS <br />Greely St. Water Quality Retrofit Division 1 – GENERAL REQUIREMENTS January 2026 <br />WO No. UP3817 SP – 50 <br />appeal. Any protest by Bidder of the Director decision must be in strict conformity to <br />Everett Municipal Code Chapter 3.46, Bid Protest Procedures. <br />1-02.2 Plans and Specifications <br />Delete all paragraphs in 1-02.2 and substitute the following: <br />Information as to where Bid Documents can be obtained or reviewed will be found in the <br />Call for Bids (Advertisement for Bids) for the Work. <br />After Award of the Contract, the Contractor will receive up to six sets of the reduced <br />Plans (11" x 17") and accompanying Special Provisions. In addition, the City will supply <br />up to three sets of full size plans (22" x 34"). All Plans and Special Provisions will be <br />conformed with addenda unless Contractor requests otherwise. <br />Additional Plans and Special Provisions may be purchased by payment of the current <br />printing costs. <br />1-02.4 Examination of Plans, Specifications, and Site of Work <br />1-02.4(1) General <br />Delete the fifth paragraph of 1-02.4(1), beginning with “Bid prices shall reflect”, and <br />substitute the following: <br />Bid prices shall include everything necessary for the completion of the Work <br />including, but not limited to, providing the materials, equipment, tools, plant and <br />other facilities, and the management, superintendence, labor, and all necessary <br />testing services. <br />Revise the first sentence in the paragraph that begins with “Any prospective Bidder <br />desiring an explanation” to read as follows: <br />Any prospective Bidder desiring an explanation or interpretation of the Bid <br />Documents, shall request the explanation or interpretation in writing by close of <br />business three business days preceding the bid opening to allow a written reply to <br />reach all prospective Bidders before the submission of their Bids. <br />Supplement 1-02.4(1) by adding the following: <br />Bidder acknowledges that Bidder has not relied on representation or warranty of the <br />City not expressly included in the Contract Documents. <br />The information provided by the City is not intended to be a substitute for, or a <br />supplement to, the independent verification by Bidder to the extent such <br />independent investigation of the Drawings and Specifications or Site conditions is <br />deemed necessary or desirable by the Bidder. Bidder acknowledges that they have <br />not relied upon City or Engineer furnished information regarding site conditions in <br />preparing and submitting a Bid. <br /> <br />Further supplement 1-02.4(1) by adding the following: <br />1-02.4(1)A Interpretation of Contract Documents <br />(******) <br />Should a Bidder find what is believed to be discrepancies in or omissions from the <br />Plans, Specifications, or Special Provisions, or should the Bidder be in doubt as to <br />their meaning, Bidder may submit to the Engineer a written request for an <br />interpretation thereof. The Bidder submitting the request will be responsible for its <br />prompt delivery. Any interpretation of the documents, if made, will be made only by <br />addendum duly issued and a copy of such addendum will be mailed or delivered to <br />each Bidder receiving a set of such documents. All requests for interpretations <br />must be received by the City or Engineer no later than 7 calendar days prior
