All coverage for Subcontractors shall be subject to all the requirements stated herein and applicable to their profession. If Contractor does not include Subcontractors as insured under Contractor’s own insurance policies, Contractor shall be responsible for assuring that all Subcontractors obtain all insurance as required by this Agreement and that the Owner be specifically endorsed as an additional insured on such insurance. The insurance requirements for each Subcontractor are the same as for Contractor, except that for subcontracts with value less than $1 million, the requirements in 15.3.14.4 and 15.3.14.7 are adjusted for such subcontracts as follows: • The Bodily Injury and Property Damage limits from 15.3.14.4 shall be: $ 2,000,000 General Aggregate $ 1,000,000 Products & Completed Operations Aggregate $ 1,000,000 Personal & Advertising Injury $ 1,000,000 Each Occurrence $ 100,000 Fire Damage • Pollution Liability policy from 15.3.14.7 shall provide at least $1,000,000 per occurrence coverage for Bodily Injury and Property Damage. All other insurance requirements remain unchanged.” Item 3 - SECTION 00 73 00 SPECIAL CONDITIONS: Add the following paragraph: “PART 7 – BNSF RAILWAY COMPANY 7.1 Owner has obtained BNSF licenses, including 25W-24305/BF- 20565661, 25W-24307/BF-20565618, 25W-24309/BF-20565614, and 25W-24310/BF-20599261 (the “BNSF Licenses”). Contractor shall comply with the BNSF Licenses, including without limitation all of BNSF’s applicable safety rules and regulations. 7.2 Contractor shall cause BNSF RAILWAY COMPANY to be an additional insured under all liability insurance policies required under this Contract. 7.3 Certain provisions of the BNSF Licenses require Owner to cause Contractor to indemnify, defend and hold harmless BNSF RAILWAY COMPANY and certain other persons, including without limitation under Sections 13.2, 13.4, and 15.6 of the BNSF Licenses. Contractor is hereby obligated to so indemnify, defend and hold harmless BNSF RAILWAY COMPANY. Those provisions of the BNSF Licenses are hereby incorporated as though fully set forth herein.”
