2026 Pavement Maintenance Overlay Special Provisions PW# 3860 SP - 8 March 5, 2026 1 2. The Contracting Agency receives the request before the time set for receipt of 2 Bid Proposals, and 3 3. The revised or supplemented Bid Proposal (if any) is received by the Contracting 4 Agency before the time set for receipt of Bid Proposals. 5 6 If the Bidders request to withdraw, revise, or supplement its Bid Proposal is received 7 before the time set for receipt of Bid Proposals, the Contracting Agency will return the 8 unopened Proposal package to the Bidder. The Bidder must then submit the revised or 9 supplemented package in its entirety. A Proposal will be considered irregular and will be rejected if: 28 a. The Bidder is not prequalified when so required; 29 b. The Bidder adds provisions reserving the right to reject or accept the Award, 30 or enter into the Contract; 31 c. A price per unit cannot be determined from the Bid Proposal; 32 d. The Proposal form is not properly executed; 33 e. The Bidder fails to submit or properly complete a subcontractor list as required 34 in Section 1-02.6; 35 f. The Bidder fails to submit the Bidder Questionnaire, if applicable, as required 36 by Section 1-02.6, or if the documentation that is submitted fails to meet the 37 requirements of the Special Provisions; or 38 g. The Bid Proposal does not constitute a definite and unqualified offer to meet 39 the material terms of the Bid invitation. 40 41 2. A Proposal may be considered irregular and may be rejected if: 42 a. The Proposal does not include a unit price for every Bid item; 43 b. Any of the unit prices are excessively unbalanced (either above or below the 44 amount of a reasonable Bid) to the potential detriment of the Contracting 45 Agency; 46 c. The authorized Proposal Form furnished by the Contracting Agency is not 47 used or is altered; 48 d. The completed Proposal form contains unauthorized additions, deletions, 49 alternate Bids, or conditions; 50 e. Receipt of Addenda is not acknowledged;
