If Proposal form entries are not made in ink. <br />5 <br />6 1-03.GR1 <br />7 Award and Execution of Contract <br />8 <br />9 1-03.1.RTF <br />10 1-03.1 Consideration of Bids <br />11 (December 30, 2022 APWA GSP) <br />12 <br />13 Revise the first paragraph to read: <br />14 <br />15 After opening and reading proposals, the Contracting Agency will check them for <br />16 correctness of extensions of the prices per unit and the total price. If a discrepancy exists <br />17 between the price per unit and the extended amount of any bid item, the price per unit will <br />18 control. If a minimum bid amount has been established for any item and the bidders unit or <br />19 lump sum price is less than the minimum specified amount, the Contracting Agency will <br />20 unilaterally revise the unit or lump sum price, to the minimum specified amount and <br />21 recalculate the extension. The total of extensions, corrected where necessary, including <br />22 sales taxes where applicable and such additives and/or alternates as selected by the <br />23 Contracting Agency, will be used by the Contracting Agency for award purposes and to fix <br />24 the Awarded Contract Price amount and the amount of the contract bond. <br />25 <br />26 1-03.1(1).RTF <br />27 1-03.1(1) Identical Bid Totals <br />28 (February 17, 2026 APWA GSP) <br />29 <br />30 Revise this section to read: <br />31 <br />32 After opening Bids, if two or more lowest responsive Bid totals are exactly equal, then <br />33 the tie-breaker will be the Bidder that proposed to use the highest percentage of recycled <br />34 materials in the Project, per the form submitted with the Bid Proposal, if required. If those <br />35 percentages are also exactly equal or if the form was not required, then the tie-breaker <br />36 will be determined by drawing as follows: Two or more slips of paper will be marked as <br />37 follows: one marked Winner and the other(s) marked unsuccessful. The slips will be <br />38 folded to make the marking unseen. The slips will be placed inside a box. One <br />39 authorized representative of each Bidder shall draw a slip from the box. Bidders shall <br />40 draw in alphabetical order by the name of the firm. The slips shall be unfolded and the <br />41 firm with the slip marked Winner will be determined to be the successful Bidder and <br />42 eligible for Award of the Contract. Only those Bidders who submitted a Bid total that is <br />43 exactly equal to the lowest responsive Bid, and with a proposed recycled materials <br />44 percentage that is exactly equal to the highest proposed recycled materials amount, are <br />45 eligible to draw. <br />46
