2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 17 March 5, 2026 <br />1 <br />2 The Contractor shall perform the following measures to minimize construction noise: <br />3 <br />4 1. All trucks performing export haul shall have well maintained bed liners as <br />5 inspected and accepted by the Engineer. <br />6 <br />7 2. Truck tailgate banging is prohibited. All truck tailgates shall be secured to prevent <br />8 excessive noise from banging. <br />9 <br />10 3. A copy of the noise exemption and/or variance shall be kept on the project site <br />11 at all times. <br />12 <br />13 *** <br />14 4. Any back-up alarms shall be directional broad band type alarms. <br />15 <br />16 5. All other conditions of the City of Everett Noise Variance for 2026 Pavement <br />17 Maintenance Overlay WO3860 dated February 26, 2026 shall be adhered to. <br />18 See appendix for copy of the Noise Variance. <br />19 <br />20 6. The Contracting Agency will provide the Nighttime Work Mail Notification, and <br />21 the Contractor shall submit the following information to the Contracting Agency <br />22 20 working days prior to the start of nighttime Work: <br />23 <br />24 a. Start date and duration of the nighttime Work. <br />25 b. List of the expected nighttime noise sources. <br />26 c. List of noise mitigation measures to be implemented. <br />27 *** <br />28 <br />29 General <br />30 Failure of the Contractor to perform all obligations under this Special Provision will result <br />31 in the suspension of all night Work until a corrective Work plan is accepted by the Engineer. <br />32 Working days will continue to accrue during the period of suspension. <br />33 <br />34 The Contractor shall be responsible for obtaining all exemptions or variances to perform <br />35 nighttime Work outside the project limits such as staging areas. A copy of each exemption <br />36 or variance obtained by the Contractor shall be provided to the Contracting Agency before <br />37 proceeding with the nighttime Work. <br />38 <br />39 Other noise mitigation measures may be required, and it is understood that the Contractor <br />40 is responsible for devising methods that comply with all ordinances. Compliance with the <br />41 above noise mitigation measures shall not be considered a warranty that the equipment <br />42 or the activity will comply with all local regulations. <br />43 <br />44 Payment <br />45 All costs to comply with the above noise exemption/variance requirements shall be <br />46 included in the associated items of Work. <br />47
