2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 16 March 5, 2026 <br />1 <br />2 1-07.GR1 <br />3 Legal Relations and Responsibilities to the Public <br />4 <br />5 1-07.1.RTF <br />6 1-07.1 Laws to be Observed <br />7 (October 1, 2005 APWA GSP) <br />8 <br />9 Supplement this section with the following: <br />10 <br />11 In cases of conflict between different safety regulations, the more stringent regulation <br />12 shall apply. <br />13 <br />14 The Washington State Department of Labor and Industries shall be the sole and <br />15 paramount administrative agency responsible for the administration of the provisions of <br />16 the Washington Industrial Safety and Health Act of 1973 (WISHA). <br />17 <br />18 The Contractor shall maintain at the project site office, or other well known place at the <br />19 project site, all articles necessary for providing first aid to the injured. The Contractor <br />20 shall establish, publish, and make known to all employees, procedures for ensuring <br />21 immediate removal to a hospital, or doctors care, persons, including employees, who <br />22 may have been injured on the project site. Employees should not be permitted to work on <br />23 the project site before the Contractor has established and made known procedures for <br />24 removal of injured persons to a hospital or a doctors care. <br />25 <br />26 The Contractor shall have sole responsibility for the safety, efficiency, and adequacy of <br />27 the Contractors plant, appliances, and methods, and for any damage or injury resulting <br />28 from their failure, or improper maintenance, use, or operation. The Contractor shall be <br />29 solely and completely responsible for the conditions of the project site, including safety for <br />30 all persons and property in the performance of the work. This requirement shall apply <br />31 continuously, and not be limited to normal working hours. The required or implied duty of <br />32 the Engineer to conduct construction review of the Contractors performance does not, <br />33 and shall not, be intended to include review and adequacy of the Contractors safety <br />34 measures in, on, or near the project site. <br />35 <br />36 <br />37 f1-07.1.OPT6.FR1.docx <br />38 <br />39 (October 3, 2022) <br />40 *** City of Everett *** Noise Exemption/Variance Conditions <br />41 The jurisdiction(s) listed below has granted a nighttime noise exemption and/or variance <br />42 to its respective noise control code and WAC 173-60 to allow Contracting Agency <br />43 representatives to perform nighttime Work under the conditions as listed below. <br />44 <br />45 Jurisdiction Nights Expiration Date <br />46 *** City of Everett *** *** 72 *** *** October 31, 2026 *** <br />47 <br />48 <br />49 This exemption/variance allows the Contractor to exceed the local noise ordinance levels. <br />50 All nighttime Work activities require approved noise exemptions or variances from the <br />51 listed jurisdiction(s) including nighttime Work within the Contracting Agencys Right-of- <br />52 Way.
