2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 19 March 5, 2026 <br />1 For work performed in such cases, the Contractor shall collect from the Contracting <br />2 Agency, retail sales tax on the full contract price. The Contracting Agency will <br />3 automatically add this sales tax to each payment to the Contractor. For this reason, the <br />4 Contractor shall not include the retail sales tax in the unit bid item prices, or in any other <br />5 contract amount subject to Rule 170, with the following exception. <br />6 <br />7 Exception: The Contracting Agency will not add in sales tax for a payment the Contractor <br />8 or a subcontractor makes on the purchase or rental of tools, machinery, equipment, or <br />9 consumable supplies not integrated into the project. Such sales taxes shall be included in <br />10 the unit bid item prices or in any other contract amount. <br />11 <br />12 1-07.2(3) Services <br />13 <br />14 The Contractor shall not collect retail sales tax from the Contracting Agency on any <br />15 contract wholly for professional or other services (as defined in Washington State <br />16 Department of Revenue Rules 138 and 244). <br />17 <br />18 1-07.7.GR1 <br />19 Load Limits <br />20 <br />21 1-07.7.INST1.GR1 <br />22 Section 1-07.7 is supplemented with the following: <br />23 <br />24 1-07.7.OPT6.GR1 <br />25 (March 13, 1995) <br />26 If the sources of materials provided by the Contractor necessitates hauling over roads <br />27 other than State Highways, the Contractor shall, at the Contractor’s expense, make all <br />28 arrangements for the use of the haul routes. <br />29 <br />30 1-07.8.GR1 <br />31 High-Visibility Apparel <br />32 <br />33 1-07.8(1).GR1 <br />34 Traffic Control Personnel <br />35 <br />36 1-07.8(1).INST1.GR1 <br />37 Section 1-07.8(1) is revised to read: <br />38 <br />39 1-07.8(1).OPT1.2027.GR1 <br />40 (September 16, 2025) <br />41 All personnel performing the Work described in Section 2-04 (including traffic control <br />42 supervisors, flaggers, and others performing traffic control labor of any kind) shall <br />43 comply with the following: <br />44 <br />45 1. During daylight hours with clear visibility, workers shall wear a high-visibility <br />46 ANSI/ISEA 107 Type R Class 2 or 3 garment with background material that <br />47 are fluorescent yellow-green, fluorescent orange-red, or fluorescent red in <br />48 color; and a high visibility hardhat that is white, yellow, yellow-green, orange, <br />49 or red in color; and <br />50 <br />51 2. During hours of darkness (‰ hour before sunset to ‰ hour after sunrise) or <br />52 other low-visibility conditions (snow, fog, etc.), workers shall wear a high-
