2026 Pavement Maintenance Overlay Special Provisions <br />PW# 3860 SP - 21 March 5, 2026 <br />1 as set by the Washington State Apprenticeship Training Council and Washington <br />2 State Department of Labor and Industries (L&I). <br />3 <br />4 Electronic Reporting <br />5 The Contractor shall use the PWIA System to submit the Apprentice Utilization Plan. <br />6 Reporting instructions are available in the application. <br />7 <br />8 Apprentice Utilization Plan <br />9 The Contractor shall submit an Apprentice Utilization Plan by filling out the Apprentice <br />10 Utilization Plan Form (WSDOT Form 424-004) or other form approved by the Contracting <br />11 Agency within 30 calendar days of Contract execution, however no later than the <br />12 preconstruction meeting, demonstrating how and when they intend to achieve the <br />13 Apprentice Utilization Requirement. The Plan shall be in sufficient detail for the Engineer <br />14 to track the Contractors progress in meeting the utilization requirements. An Apprentice <br />15 Utilization Plan shall be updated and resubmitted as the Work progresses or when <br />16 requested by the Engineer or other Contracting Agency representative. <br />17 <br />18 If the Contractor is unable to demonstrate the ability to meet the Apprentice Utilization <br />19 Requirement with their initial Apprentice Utilization Plan submission, an effort must be <br />20 made to find additional registered apprentices to perform on the contract. If after <br />21 attempts have been made at every tier and every scope, the Contractor must submit <br />22 GFE documentation to the Contracting Agency. The Contractor shall actively seek out <br />23 opportunities to meet the Apprentice Utilization Requirement during the construction <br />24 Work. <br />25 <br />26 Subcontracts <br />27 The Contractor must not require subcontractors to attain more than 15% of a <br />28 subcontracts proposed labor hours for the subcontracts scope of Work. <br />29 <br />30 Contacts <br />31 The Contractor may obtain information on State-approved Apprenticeship Training <br />32 Programs by using the Apprentice Registration and Tracking System (ARTS) <br />33 https://secure.lni.wa.gov/arts-public/#/program-search or contacting the Department of <br />34 Labor and Industries directly at: <br />35 <br />36 Specialty Compliance and Services Division, Apprenticeship Section, P.O. Box <br />37 44530, Olympia, WA 98504-4530 or by phone at (360) 902-5320. <br />38 <br />39 Compliance <br />40 The Contractor is expected to make attempts to employ Apprentices and shall include <br />41 the requirement in any subcontracts at any tier. In the event that the Contractor is unable <br />42 to achieve the Apprentice Utilization Requirement, the Contractor shall submit GFE <br />43 documentation demonstrating the efforts and attempts they made. Final GFE <br />44 documentation shall be submitted to the Contracting Agency after Substantial <br />45 Completion but no later than 30 days after Physical Completion. <br />46 <br />47 If the Contractor fails to actively attempt to employ Apprentices, submit GFE <br />48 documentation, or if the Engineer does not approve the GFE, the Contractor will be <br />49 assessed a penalty. The Engineer will provide the Contractor with a written notice at <br />50 Final Acceptance of the project informing the Contractor of the failure to comply with this <br />51 specification which will include a calculation of the penalty to be assessed as provided <br />52 for in the Payment section in this special provision.
