Page 10 <br />Everett Multipurpose Stadium <br />March 6, 2026 <br /> <br /> <br />to be performed hereunder, then the prevailing party in such litigation shall, in addition to other <br />remedies, be entitled to reasonable attorneys’ fees, including recovery costs and attorneys’ fees on any <br />appeal. <br /> <br />Hazardous Materials and Pollution <br />Säzän Group is not suited to provide and has not been retained to provide any services related to <br />hazardous materials or pollution. Säzän Group assumes no knowledge or liability in connection with <br />the presence, handling, or removal of asbestos, pollutants, mold, mildew or other hazardous materials <br />or waste. The Client shall retain an expert consultant to deal with those conditions and exposures <br />should they arise. Recognizing this limit on the Säzän Group’s services, the Client agrees to indemnify <br />and hold harmless Säzän Group against any costs, expenses, or liabilities arising from any disputes, <br />claims, or third party claims purportedly, or in fact, caused by exposure to asbestos or other discharge, <br />dispersal, release or escape of pollutants or other hazardous materials or waste relating to this project. <br />Progressive Design-Build Contract for Everett Outdoor Event Center <br />Exhibit to Amendment No. 1 - Phase 1B Work and Fee Proposal
