NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: Section 6.010 of Ordinance No. 1671-89 as amended by Section 37 of Ordinance No. 2397-99, (foot note 24 of Table 6.1 of Chp. 19.6 EMC), as amended, which reads as follows: Development Standards Table. Minimum Required Setback, footnote (24), 50 feet when abutting lots located in residential zones. Is hereby amended to read as follows: Development Standards Table. Minimum Required Setback, footnote (24), 25 feet when abutting lots located in residential zones. Section 2: Section 5.010 of Ordinance No. 1671-89, as amended by Section 36 of Ordinance No. 2397-99, (foot note 11 of Table 5.2 of Chp. 19.5 EMC), as amended, which reads as follows: BUSINESS/COMMERCIAL, Retail, indoor, footnote (11), Permitted only as an accessory use for those products produced on premises. Is hereby amended to read as follows: BUSINESS/COMMERCIAL, Retail, indoor, footnote (11), Permitted as an accessory use for those products produced on premises, up to but no more than 20% of goods sold may be produced off-site and by other producers. Section 3: That should any section, subsection,paragraph, sentence clause or phrase set forth in this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional.
