Category 2: For official use only / disclosure permissible by <br />Category 2: For official use only / disclosure permissible by law. <br />interruption, arising out of this Agreement, even if advised of the possibility of such <br />damages. <br />Nothing in this section shall limit liability resulting from gross negligence, willful <br />misconduct, or obligations that cannot be limited under applicable law. <br />8. FORCE MAJEURE: <br />Notwithstanding any provisions to the contrary within this Agreement, neither Party shall <br />be held liable to the other Party, or to any other individual or entity, for any failure by PGM <br />PR or the Client, as applicable, to fulfill its obligations under this Agreement in the event <br />that such failure is caused by or arises from: (i) an act of God; (ii) an act of a public enemy; <br />(iii) an act of any local, county, state, federal, or other government in its sovereign or <br />contractual capacity; (iv) an act of war or terrorism; (v) a riot; (vi) a fire, flood, or adverse <br />weather condition; (vii) an epidemic or quarantine; (viii) an act of sabotage; (ix) a strike, <br />lock-out, or other labor disturbance; or (x) any other cause beyond the reasonable control <br />of either Party (each referred to as a "Force Majeure Event"). During the period in which <br />such failure(s) causes non-performance, the non-performing Party's obligations shall be <br />excused.
