j ti... _ d +1 :Cf Tip n'q &Y <br /> y <br /> tr .6 <br /> k � <br /> gg �4 1 T 'a rr { <br /> 1 icy. fix( <br /> for the purpose of a public street and highway forever, and that all <br /> the lands , rights, privileges and other property adjoining or <br /> proximate to said limits which are necessary ,ib be taken, used or <br /> damaged in said opening up and establishment of said street, be, <br /> and the same are hereby condemned and appropriated to the Public uses <br /> Section 3: That the city attorney be and he is hereby <br /> authorized and directed to file in the Superior Court of the state <br /> of Washington in and for the county of Snohomish, in the name of <br /> the city of Everett, a petition complying with the requirements of <br /> the laws of the state of Washington and praying that the just com- <br /> pensation to be made for the lands and other property and property <br /> rights to be taken or damaged by the opening up and establishing of <br /> said street , as provided herein, be ascertained by a jury or by <br /> the court in case a jury be waived. <br /> Section 4: An assessment shall be made in the manner <br /> provided by law for the purpose of raising the amount necessary to <br /> pay the compensation and damages which shall be awarded for the prop- <br /> erty taken or damaged, as aforesaid, together with the costs of all <br /> proceedings to be had therein, and including also the cost of making <br /> and collecting said assessment, and said assessment shall be made <br /> subject to the provisions of said laws upon all the property spec- <br /> ially benefited by the opening up, establishing and extending of <br /> said streets Any part of the compensation, damages or costs that <br /> is not finally assessed against said property specially benefited <br /> shall be paid from the gen:ral fund of the city of Everett.
