ORDINANCE NO. \U ly AN ORDINANCE GRANTING TO THE NORTHERN PACIFIC RAILWAY COMPANY, ITS SUCCESSORS AND ASSIGNS, A FRANCHISE TO LOCATE, LAY DOWN, MAIN- TAIN AND OPERATE CERTAIN RAILROAD TRACKS OVER AND ACROSS CERTAIN STREETS AND ALLEYS IN THE CITY OF EVERETT . THE CITY OF EVERETT DOES ORDAIN: Section I: That there be and there hereby is granted to the Northern Pacific Railway Company, a corporation under the laws of the State of Wisconsin, and to its successors and assigns, the right , privilege and authority to locate, lay down, construct , maintain and operate certain standard gauge railroad tracks over ada across the following named streets and alleys in the city of Everett , to-wit : One track over and across McDougall Avenue between California Street and Hewitt Avenue; one track over and across California Street between McDougall Avenue and Broadway Street ; one track over and across the- alley in Block 662, 'Plat of Everett ' ; and two tracks over and across Everett Avenue, between McDougall Avenue and Broadway Street. Section 2: This ordinance and the grant hereby made applies solely to a steam railroad engaged in intrastate and interstate commerce. Section 3: The grant in this ordinance contained is wade expressly subject to the following conditions and requirements: (a) The grantee, its successors and assigns, in constructing said railway, shall not tear up any street or obstruct the travel thereon further than is unavoidable and shall keep such railway at all times in good repair, and upon the completion of any portion of its track, shall leave the street in as good condition for travel as the same was before such work was done; and that to whatever extent the city of Everett shall cause any portion of said street upon which any part of said railway shall have been laid down to be paved,
