macadamized or planked, or re-paved, re-macadamized or re-planked, <br /> said grantee or its assigns shall at the same time, at its expense, <br /> pave, macadamize or plank the same, and keep the same in repair, <br /> within and between the rails and for one foot on the outside of the <br /> outside rails of its tracks, and the space between the inner rails, <br /> where a double track. is laid, in the same manner and at the 'same. <br /> level and with the same material as shall be used in paving or <br /> planking the rest of said street, provided that the portion of <br /> said street to be so improved by said grantee or its assigns may <br /> be improved with pavement of such kind and character as may meet <br /> with the approval of the city council; and on streets or portions of <br /> streets which are not paved, planked or macadamized, the owner of <br /> such railway shall maintain and plank crossings over its tracks at <br /> all street intersections which are actually used for crossings of <br /> teams, and at all other locations where teaming is customarily <br /> carried on across such tracks, and any other parts that may be re- <br /> quired by the city council. <br /> (b) The council shall have the right, whenever such action <br /> is necessary in the interest of public safety or convenience, to <br /> require the grantee, its successors or assigns, to flag its engines <br /> or trains across public streets or to install automatic alarm bells <br /> at street crossings; or to employ watchmen at street crossings; or to <br /> establish and operate gates at street crossings; or to require the <br /> elevation or depression of the tracks laid down under this franchise. <br /> (c ) Whenever reasonable necessity therefor exists and said city <br /> shall so require by ordinance, said grantee, its successors or <br /> assigns, shall construct overhead viaducts on streets traversed or <br /> crossed by said grantee, its successors or assigns, at any intersec- <br /> tion or crossing thereof, over the tracks hereby authorized, by which <br /> viaduct or viaducts teams, vehicles, foot passengers and traffic of <br /> all kinds may be enabled to pass along said street at a proper <br /> elevation above said tracks, which viaducts, or any of them, shall <br /> be of such material and shall be built, maintained and renewed <br />
