a. No additional over water construction is involved except that pier, dock, <br /> or float construction may be increased by five hundred (500) square feet or ten <br /> (10)percent from the provisions of the original permit, whichever is less; <br /> b. Ground area coverage and height may be increased a maximum of ten(10) <br /> percent from the provisions of the original permit; <br /> c. The revised permit does not authorize development to exceed height, lot <br /> coverage, setback, or any other requirements of the applicable master program <br /> except as authorized under a variance granted as the original permit or a part <br /> thereof; <br /> d. Additional or revised landscaping is consistent with any conditions <br /> attached to the original permit and with the applicable master program; <br /> e. The use authorized under the original permit is not changed; and <br /> f. No increased adverse environmental impact will be caused by the project <br /> revision. <br /> 4. If a revision to a permit is authorized after the original permit expired, the purpose <br /> of such revisions shall be limited to authorization of changes which are consistent <br /> with this section and which would not require a permit for the development or <br /> change proposed under the terms of RCW 90.58, WAC 173-27-110, or the City's <br /> Shoreline Master Program. If the proposed change constitutes substantial <br /> development, then a new permit is required. <br /> 5. If the proposed changes or the sum of the proposed revision and any previously approved <br /> revisions are not within the scope and intent of the original permit, the applicant shall <br /> apply for a new shoreline permit in the manner provided for in this chapter. <br /> 6. An application for a new permit may use or rely upon previous environmental <br /> review and supporting studies (such as biological assessments), as provided by the <br /> SEPA ordinance. <br /> E. Enforcement Provisions for Shoreline Regulations. The City adopts by <br /> reference the enforcement provisions of WAC 173-27-240 through WAC 173-27-300. <br /> Further, any person, firm or corporation who violates any provision of the City's <br /> shoreline regulations shall be subject to the City's Civil Enforcement Procedures set forth <br /> in EMC 1.20. The enforcement provisions and procedures provided herein are not <br /> exclusive and the City is authorized to pursue any remedy it deems appropriate or is <br /> otherwise provided by law. <br /> 39 <br />
