<br /> <br /> <br />EXHIBIT C <br />END USER ACCEPTANCE OF GOVSTREAM TERMS <br />City shall ensure that any End User accessing or using any Govstream-provided tools, functionality, or services—whether <br />accessed through City’s website or a Govstream -hosted environment—is required, as a condition of such access or use, to <br />acknowledge and accept Govstream’s then -current Terms of Use and Privacy Policy. <br />City shall work with Govstream to implement a commercially reasonable mechanism (e.g., click -through acceptance, redirect, <br />or embedded acknowledgment) to ensure such acceptance occurs prior to or at the time of End User access to Govstream- <br />provided services. <br />City shall not take any action that would prevent, limit, or undermine the enforceability of Govstream’s Terms of Use or Priv acy <br />Policy as applied to End Users, and acknowledges that Govstream’s Terms of Use shall govern End Users’ use of Govstream- <br />provided services notwithstanding that such services may be accessed through City -controlled interfaces. <br />Upon reasonable request, City shall provide Govstream with confirmation of the mechanism used to facilitate End User <br />acceptance of Govstream’s Terms of Use and Privacy Policy. <br /> <br />
