BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Board of adjustment created. <br /> A. Created - Purpose - Membership - Term. A board of adjustment is herewith <br /> established. The board shall hear and decide all applications for variances from the <br /> provisions of requirements of this title except as specified in Section 41.130. The board <br /> members shall be appointed by the Mayor with consent of the Council and shall consist <br /> of citizens having an understanding of the benefits of zoning to the municipality. <br /> B. Meetings. Meetings of the board shall be held at such times as the chairman of the <br /> board may determine, or upon request of the City administration. There shall be a fixed <br /> place of meetings, and all regular board meetings shall be open to the public. Notice of all <br /> public hearings before the board shall be given in accordance with the public notice <br /> provisions of the City's Local Project Review Procedures Ordinance. The board shall <br /> adopt its own rules of procedure and keep a record of its proceedings, findings and action <br /> in each case, and the vote of each member on each question considered in the <br /> proceedings. The presence of a majority of the entire membership shall be necessary to <br /> constitute a quorum. In order to approve any item or application brought before the board <br /> of adjustment, a majority of the board as constituted shall be required to vote in favor of <br /> such an approval. <br /> SECTION 15: That Chapter 41 of Ordinance No. 1671-89 as amended by Section 10 of <br /> Ordinance No. 1811-91, Sections 63 and 64 of Ordinance No. 1849-92, Section 3 of <br /> Ordinance No. 2290-98 and Sections 63-68 of Ordinance No. 2397-99 (EMC 19.41.150) <br /> which reads in part as follows: <br /> Special property uses. <br /> A. User Guide. A special property use is a use by its unique nature or scale has qualities <br /> or impacts which cannot be classified into a particular zone and must be given careful <br /> consideration before the city allows the establishment of such a use. In certain cases, a <br /> use which is permitted in a particular zone may be allowed in another zone only through <br /> the special property use permit. <br /> B. Review Process. All of the uses specified in subsection D of this section are special <br /> property uses. The use-standards table in each zone indicates which of the special <br /> property uses shall be permitted in each zone, and which review process shall be used to <br /> evaluate a particular use in a particular zone. Special property uses shall be evaluated for <br /> the following criteria, depending upon which review process is required by the use- <br /> standards table: <br /> 1. Review Process II.B. All special property uses shall be evaluated for the criteria listed <br /> in subsections C and D of this section. The planning director shall also have the <br /> discretion to approve a minor expansion of an existing use which this chapter classifies as <br /> a special property use, or to require the proposed expansion to be reviewed using Review <br /> Process III.B. For purposes of this section, a minor expansion shall be not more than <br /> twenty-five percent of the land or building gross floor area devoted to the existing special <br /> property use. <br /> 19 <br />
