C. Waived Hearing - Environmentally Sensitive Areas — Affected Property Owners <br /> Notified. For those decisions for which this chapter requires a planning director Review <br /> Process II.C, the review process shall be identical to that required for Review Process <br /> II.B, except that the notification requirements shall be extended beyond the three hundred <br /> foot range required for Review Process II.B to include all property owners that could be <br /> affected by the modification to the requirements of this chapter that has been requested <br /> by the applicant,particularly those owners of properties that could be affected by changes <br /> that would modify surface hydrology. <br /> 19.42.110 Process III -Hearing examiner review. <br /> A. 1. Appeal of Application of Development Standards. Appeals of the application of <br /> development standards by the planning department or planning director in the <br /> administration of this title shall be heard by the hearing examiner. The hearing examiner <br /> shall use the criteria listed in subsection 41.180C to evaluate any such appeal. Such <br /> appeals shall be filed in a timely manner in the accordance with subsection 41.180E. <br /> 2. Appeal of Planning Director's Decision on Uses Requiring Review Process II.B. <br /> Appeals of decisions made by the planning <br /> director for uses which require Review Process II.B shall be heard by the hearing <br /> examiner. The hearing examiner shall consider the findings and conclusions of the <br /> planning director in evaluation of any such request for appeal to determine if the planning <br /> director has made a reasonable application of the adopted policies and regulations of the <br /> city, and/or other applicable laws. <br /> B. Specific Land Use Actions - Public Hearing Required. Certain uses listed in the use- <br /> standards table of specific zones, and certain land use actions described in this title <br /> require review by the hearing examiner using Review Process III.B. Review Process III.B <br /> is a discretionary review process in which the hearing examiner may approve, modify or <br /> disapprove an application based upon the requirements of this title and other city <br /> ordinances. The criteria which the hearing examiner shall use in evaluating such requests <br /> are specified in this title for each underlying land use action that the hearing examiner has <br /> the authority to review. Notification shall be provided in accordance with the <br /> requirements specified for individual land use actions. <br /> 19.42.120 Process IV -Board of adjustment- Public hearing for variances. <br /> Except as otherwise provided by this title or the hearing examiner ordinance, the board of <br /> adjustment shall review all requests for variances to the provisions of this title. The <br /> criteria to be used for evaluating variance requests are specified in subsection 41.130C. <br /> Notification shall be provided in accordance with subsection 41.130E. Appeal of a <br /> decision made by the board of adjustment shall be as provided in Section 41.130 of this <br /> title. <br /> 19.42.130 Process V -Planning commission review - Public hearing required. <br /> A. Amendments to the Zoning Code Text. Proposals to amend the text of the zoning <br /> code shall be reviewed by the planning commission. The criteria to be considered in <br /> evaluating such proposals are specified in subsection 41.170C. <br /> B. Actions Related to a Specific Property. All actions related to a specific property or <br /> group of properties which are authorized by this title or other city ordinances to be <br /> 5 <br />
