developed (if a permit is issued) under zoning regulations and procedures existing at one <br /> moment in time regardless of changes made later and prior to final completion of a <br /> project. This subsection governs the effect of the adoption of the zoning ordinance and <br /> zoning map on the land use approval process and specifies the appropriate zoning <br /> regulations which shall apply. Unless specified below or as specified in other sections of <br /> this title, all building permit applications shall be reviewed in accordance with the zoning <br /> regulations established in this title. <br /> 1. Any completed building permit application not requiring a SEPA review or any other <br /> land use approval including, but not limited to, a subdivision, short subdivision, binding <br /> site plan, special property use permit, shoreline permit or rezone filed prior to the <br /> effective date of this title which complies with the ordinances in effect at the time of <br /> filing and which results in the issuance of a building permit shall be subject to the zoning <br /> ordinance in effect at the date of filing; <br /> 2. If a building permit application requires only a SEPA review as a condition precedent <br /> and does not require any other land use approval including, but not limited to, <br /> subdivision, short subdivision, binding site plan, special property use permit, shoreline <br /> permit or rezone and a completed SEPA application which complies with all ordinances <br /> and policies in effect as of the date its filing has been filed prior to or as of the effective <br /> date of this title, it shall be subject to the zoning ordinance(s) in effect at the date of filing <br /> of the SEPA application if within ninety days of the date of issuance of the threshold <br /> determination or a final EIS or within ninety days of the effective date of the ordinance <br /> codified in this title in the case of a threshold determination made prior to the effective <br /> date of the ordinance codified in this title, a completed building permit application(s) is <br /> filed with the city's building department conforming to the SEPA review which filing <br /> results in the issuance of a building permit for all activity approved by the SEPA review <br /> for that proposal; <br /> 3. Any land use application for a shoreline substantial development permit which is filed <br /> prior to the effective date of the ordinance codified in this title and complies with the <br /> ordinances and laws in effect at the time of filing which results in the issuance of a <br /> shoreline substantial development permit shall be subject to the zoning ordinances in <br /> effect at the time of filing, provided a completed building permit application is filed <br /> pursuant to such approval which filing results in the issuance of a permit; <br /> 4. Any land use application for a rezone which has had a public hearing in whole or in <br /> part before the city's land use hearing examiner, planning commission or city council <br /> prior to the effective date of the ordinance codified in this title shall be processed in <br /> accordance with the zoning ordinances in effect at the time of such public hearing. If the <br /> rezone is approved, the ordinance codified in this title shall apply to the development of <br /> any property subject to such rezone unless otherwise specified in the rezone; <br /> 5. Any variance from the city's zoning ordinance(s) granted prior to the effective date of <br /> the ordinance codified in this title shall apply notwithstanding the provisions of the <br /> ordinance codified in this title. <br /> 6. If a fully completed short subdivision application which complies with all ordinances <br /> and policies in effect as of the date of its filing is filed prior to the effective date of the <br /> ordinance codified in this title, it shall be subject to the zoning ordinance(s) in effect at <br /> the date of filing if within ninety days of the date of issuance of final short subdivision <br /> approval or within ninety days of the effective date of the ordinance codified in this title <br /> 3 <br />
