in the case of a final short subdivision approval issued prior to the effective date of the <br /> ordinance codified in this title, a completed building permit application(s) is filed with <br /> the city's building department conforming to the final short subdivision approval which <br /> filing results in the issuance of a building permit for all activity approved by the final <br /> short subdivision approval; <br /> 7. A proposed subdivision (ten or more lots) or binding site plan for which a fully <br /> completed application has been filed prior to the effective date of the ordinance codified <br /> in this title, shall be reviewed in accordance with the zoning ordinance(s) in effect at the <br /> time of the application for preliminary approval. Lots created by subdivisions and <br /> binding site plans for which completed building permit applications are submitted shall <br /> be governed by the zoning regulations or terms of approval required by RCW 58.17.170; <br /> provided, however, in the event there are any major changes made to the approved final <br /> plat or binding site plan, the building permit application shall be reviewed in accordance <br /> with the zoning ordinance(s) in effect at the time of building permit application; <br /> and <br /> 8. Any land use application not previously listed in this section including a special <br /> property use permit for which a completed land use application has been filed prior to the <br /> effective date of the ordinance codified in this title which complies with the ordinances <br /> and laws in effect at the time of filing which results in the issuance of a land use permit <br /> (approval) shall be subject to the zoning ordinances in effect at the time of filing; <br /> provided, a completed building permit application is filed pursuant to such approval <br /> within ninety days of the date of approval which results in the issuance of a building <br /> permit. <br /> C. This ordinance shall become effective fifteen(15) days after it becomes valid. <br /> D. Section 37 of this ordinance, Environmentally Sensitive Areas, is interim and shall <br /> remain in effect until January 15, 1991. <br /> E. All sections of Ordinance No.4041 are hereby superseded by this ordinance except for <br /> Section 4, Section 5(A), (B), (C), (D) and (E) and Section 13. <br /> F. Zoning for the property described in Exhibit B which is generally described as the Port <br /> of Everett North Marina property and Hulbert Mill property shall be M-2 until December <br /> 31, 1990, at which time it will become M-S. <br /> BE AND THE SAME IS HEREBY SUPERSEDED BY THE PROVISIONS OF <br /> THE CITY'S LOCAL PROJECT REVIEW PROCEDURES ORDINANCE AND <br /> AMENDED TO READ AS FOLLOWS: <br /> EFFECTIVE DATE - SAVINGS CLAUSE -VESTING. <br /> A.
