D. "Early notice" means the city's response to an applicant stating whether it considers <br /> issuance of a determination of significance likely for the applicant's proposal (mitigated <br /> DNS procedures). <br /> E. "Nondiscretionary project" means a project which does not involve an action which <br /> would grant the applicant any development rights which do not exist within zoning of the <br /> property at the time an application for development is submitted and includes, but is not <br /> limited to grading permits and demolition permits. <br /> F. "Nonexempt action" means any action which is not categorically exempt under Article <br /> III of this chapter or Part Nine of the SEPA rules. <br /> G. "Ordinance" means the ordinance, resolution, or other procedure used by the city to <br /> adopt regulatory requirements. <br /> H. "Responsible official" means the person designated by the mayor who shall carry out <br /> the duties and functions of the city when it is acting as the lead agency under this chapter. <br /> (See Section 20.04.080 for designation of responsible official.) <br /> I. "SEPA rules", means WAC Chapter 197-11 adopted by the State of Washington <br /> Department of Ecology. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> EMC 20.04.040 Additional definitions. <br /> In addition to those definitions contained within WAC 197-11-700 through 799, when <br /> used in this chapter, the following terms shall have the following meanings, unless the <br /> context indicates otherwise: <br /> A. "City" means the city of Everett. For purposes of SEPA policies, "City" includes the <br /> urban growth area(UGA) and adjacent airsheds and watersheds. <br /> B. "Department" means any division, subdivision or organizational unit of the City <br /> established by ordinance, rule or order. <br /> C. "Director" means the Director of the Department of Planning and Community <br /> Development or successor agencies and his/her designee. <br /> D. "Ordinance" means the ordinance, resolution, or other procedure used by the City to <br /> adopt regulatory requirements. <br /> E. "Responsible official" means the person designated by the mayor who shall carry out <br /> the City's procedural responsibilities as the lead agency under this chapter. (See Section <br /> 20.04.080 for designation of responsible official.) <br /> F. "SEPA rules", means WAC Chapter 197-11 adopted by the State of Washington <br /> Department of Ecology. <br /> SECTION 4: That Section 1C of Ordinance No. 1348-87 (EMC 20.04.050) which reads <br /> as follows: <br /> EMC 20.04.050 General policies. <br /> The city adopts by reference the general policies of the State Environmental Policy Act <br /> (SEPA) as set forth in RCW 43.21C.010 and RCW 43.21C.020. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> 4 <br />
