Q/F <br /> ORDINANCE NO. 2535-01 <br /> rk-77 <br /> An Ordinance amending the Land Use Hearing Examiner Ordinance <br /> to be consistent with the provisions of the City's Local Project <br /> Review Procedures Ordinance, superseding and amending <br /> Ordinance No. 692-80 as amended (EMC 2.23) <br /> WHEREAS, the City adopted interim permit review processes for land use permits <br /> through the adoption of Ordinance No. 2136-96; and <br /> WHEREAS, through the adoption of the City's Local Project Review Procedures <br /> Ordinance, the City has incorporated the interim regulations into the Local Project <br /> Review Procedures Ordinance which is intended to be a master procedural ordinance for <br /> land use applications within the City; and <br /> WHEREAS, consistent with the intent of making the master procedural ordinance, the <br /> procedural aspects from Land Use Hearing Examiner's Ordinance (EMC 2.23) have been <br /> incorporated into the Local Project Review Procedures Ordinance; and <br /> WHEREAS, it is the intent of this ordinance to make the necessary revisions to the Land <br /> Use Hearing Examiner's Ordinance so that those provisions that have been incorporated <br /> into the Local Project Review Procedures Ordinance are removed from the Land Use <br /> Hearing Examiner's Ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> SECTION l: That Section 12 of Ordinance No. 692-80 as amended by Section 1 of <br /> Ordinance No. 819-81, Section 1 of Ordinance No. 823-81, Section 1 of Ordinance No. <br /> 952-83, Section 1 of ordinance No. 1121-85, Section 1 of Ordinance No. 1323-87, <br /> Section 1 of Ordinance No. 1969-93, Section 2 of Ordinance No. 2137-96 and Section 1 <br /> of Ordinance No. 2331-98 (EMC 2.23.120)which reads as follows: <br /> Hearing examiner- Duties. <br /> The duties of the examiner shall be as follows: <br /> A. Development Actions. The examiner shall receive and examine available information <br /> including environmental checklists and impacts statements, conduct public hearings, <br /> prepare a record thereof, enter findings of fact and conclusions based upon those facts, <br /> and enter decisions as provided herein. <br /> 1. Decisions. The decisions of the examiner shall represent the final action on the <br /> application as herein below specified, for the following types of development actions: <br /> a. Review Process I Applications. The examiner shall render decisions on appeals of the <br /> following land use decisions: <br />
