Review Process II Applications. The examiner shall render decisions on appeals of the <br /> following land use decisions: <br /> (1) Preliminary subdivision approvals of fifty lots or less; <br /> (2) Subdivision or short subdivision alteration or vacation approvals; <br /> (3) Preliminary short subdivision approvals; <br /> (4) Reserved; <br /> (5) Subdivision or short subdivision variances of twenty-five percent or less; <br /> (6) Preliminary binding site plan and site plan approval; <br /> (7) Binding site plans variances of twenty-five percent or less; <br /> (8) Administrative shoreline permits (less than one acre); <br /> (9) SEPA determinations; <br /> (10) Stream and wetland filling and mitigation; <br /> (11) Commercial day care in multiple family zones; <br /> (12) Up to twenty-five percent expansion of a nonconforming use; <br /> (13) Determination of proportionality for correction facilities; <br /> (14) Minor expansion of an existing special property use; <br /> (15) All other review processes listed in the Zoning Code as Review Process II.A, II.B, <br /> and II.C; <br /> (16) Short subdivision division of land with nonconforming structures. <br /> c. Review Process III Applications. Following an open public hearing before the <br /> examiner, the examiner shall render a decision on the following land use applications: <br /> (1) Preliminary subdivision approvals of fifty lots or less if a open record public hearing <br /> is requested as defined in Title 18 of this code; <br /> (2) Preliminary subdivision approvals of more than fifty lots; <br /> (3) Preliminary cluster subdivision or cluster short subdivision approvals; <br /> (4) Subdivision or short subdivision alteration or vacation if a open record hearing is <br /> requested as defined in Title 18 of this code; <br /> (5) Subdivision or short subdivision variance of more than twenty-five percent; <br /> 2 <br />
