After receiving the recommendation following remand, the city council shall either accept the recommendation of the examiner or reverse the decision of the examiner accordingly. BE AND THE SAME IS HEREBY SUPERSEDED BY THE PROVISIONS OF THE CITY'S LOCAL PROJECT REVIEW PROCEDURES ORDINANCE. SECTION 11: That Section 25 of Ordinance No. 692-80 as amended by Section 9 of Ordinance No. 819-81 and Section 12 of Ordinance No. 2137-96 (EMC 2.23.240) which reads as follows: Conflicting ordinances and rules of procedure. Unless provided otherwise in this chapter, any and all ordinances or parts of ordinances of the city in conflict with this chapter are superseded by this chapter; provided, in the event there is a conflict or inconsistency between the provisions of this chapter and the city's ordinance implementing the Regulatory Reform Act (Chapter 347 of the 1995 Laws of the state of Washington) or the Act itself, the provisions of the city's ordinance implementing the Act and the Act itself shall supersede this chapter. BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: Conflicting ordinances and rules of procedure. Unless provided otherwise in this chapter, any and all ordinances or parts of ordinances of the City in conflict with this chapter are superseded by this chapter; provided, in the event there is a conflict or inconsistency between the provisions of this chapter and the City's Local Project Review Ordinance implementing Chapter 36.70 B and C, RCW , the provisions of the City's Local Project Review Ordinance shall supersede this chapter. SECTION 12: Nothing in this ordinance shall be construed as abating any official action of the City now pending under or by virtue of any of the ordinances herein superseded or amended by the adoption of this ordinance or as waiving any right of the City under the policies, provisions and regulations superseded or amended by the adoption of this ordinance. SECTION 13: If any section, subsection, paragraph, sentence, clause or phrase set forth in this ordinance or its application to any person or situation be declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance or its application to any other person or situation. The City Council of the City of Everett hereby declares that it would have adopted this ordinance and each section, subsection, sentence, clause, phrase, or portion thereof irrespective of the fact that any one or more sections, subsections, sentences, clauses, phrases or portions be declared invalid or unconstitutional. 8
