and approval of a final subdivision pursuant to all provisions of this title concerning the <br /> subdivision of land into ten or more lots, tracts or parcels. <br /> 2. When the original short subdivision contains nine or less lots, the above restrictions <br /> shall not apply to the creation of additional lots, not exceeding a total of nine. If the <br /> number exceeds nine, a new application must be filed and processed. After five years, <br /> further division may be permitted when otherwise consistent with the regulations of the <br /> city. <br /> 3. Where there have been no dedications to the public and no sales of any lots in a short <br /> subdivision, nothing contained in this section shall prohibit an applicant from completely <br /> withdrawing his entire short subdivision application and thereafter presenting a new <br /> application. <br /> BE AND THE SAME IS HEREBY AMENDED TO READ AS FOLLOWS: <br /> Land division applications shall be reviewed and processed in accordance with the <br /> procedures set forth in the City's Local Project Review Procedures Ordinance. <br /> SECTION 7: That Section 3A (EMC 18.12.010), Section 3B (EMC 18.12.020), Section <br /> 3C (EMC 18.12.030), Section 3D (EMC 18.12.040), Section 3E (EMC 18.12.050) and <br /> Section 3F (EMC 18.12.060) of Ordinance No. 2328-98 which reads as follows: <br /> EMC 18.12.010 Preapplication conference. <br /> Prior to submittal of an alteration or vacation application, a preapplication conference <br /> must be completed as defined in Section 18.08.010 of this title. <br /> EMC 18.12.020 Preliminary application submittal requirements. <br /> A. Fees. The applicant shall pay the required fees when submitting an application for <br /> alteration or vacation. <br /> B. Application Documents. The city will provide all forms and instructions for filing a <br /> completed application for an alteration or vacation. An application for an alteration or <br /> vacation shall consist of the following minimum information: <br /> 1. City application form with verification that the preapplication conference has been <br /> completed or a signed waiver has been signed by the director; <br /> 2. A project description with an attached petition containing a majority of the property <br /> owners who have an ownership interest in the lots within the subdivision, short <br /> subdivision or portion thereof to be altered or vacated; <br /> 3. If the subdivision or short subdivision is subject to restrictive covenants that were <br /> required by the city and the alteration would violate or change those restrictive covenants, <br /> the applicant is required to provide a signed petition of one hundred percent of the <br /> property owners within the subdivision or short subdivision or portion affected agreeing <br /> • or consenting to the proposed change. The director shall be responsible for determining <br /> what portion of the subdivision or short subdivision is affected by the proposed change; <br /> 4. Legal description for the property proposed for an alteration or vacation; <br /> 5. Vicinity map; <br /> 6. Declaration of ownership form signed by the owner(s); <br /> 14 <br />
