A. Required Review Process. <br /> 1. A final binding site plan shall be reviewed as a Review Process I as defined in Title 15 <br /> of this code, as amended. <br /> 2. Prior to the submittal of any preliminary binding site plan to the city for final <br /> approval, the applicant must demonstrate compliance with all of the conditions of the <br /> preliminary approval or previously approved site plan and prepare all of the necessary <br /> final documents as required in Section 18.20.050 of this chapter. <br /> 3. Applicants for final binding site plan approval shall file their final binding site plan <br /> map meeting all the requirements of Chapter 58.17 RCW and this title with the city's <br /> public works department. The public works department shall review the final binding <br /> site plan and circulate it to other city departments to determine whether the requirements <br /> of this title have been met. <br /> 4. The director and city engineer shall determine whether requirements of this title have <br /> been met. If the requirements have been met, they shall certify that the proposed final <br /> binding site plan meets the requirements of Chapter 58.17 RCW and this title. <br /> 5. If either the director or the city engineer determines that the requirements of this title <br /> have not been met, the final binding site plan shall be returned to the applicant for <br /> modification, correction, or other action as may be required for approval. <br /> 6. Pursuant to the requirements of RCW 58.17.150, neither the director nor the city <br /> engineer shall modify the requirements made in the city approval of the preliminary <br /> binding site plan or previously approved site plan when making a decision on the final <br /> binding site plan without the consent of the applicant, except as provided in Chapter <br /> 58.17 RCW. <br /> B. City Approval of Final Binding Site Plan. <br /> 1. The city, consistent with Review Process I as defined in Title 15 of this code, as <br /> amended, shall determine whether the binding site plan proposed for final approval <br /> conforms to all terms of preliminary approval, and whether the binding site plan meets <br /> the requirements of this title, applicable state laws and all other local ordinances adopted <br /> by the city which were in effect at the time of preliminary approval. <br /> 2. If the conditions have been met, the City shall inscribe and execute its written <br /> approval on the face of the binding site plan map. If the City disapproves the binding site <br /> plan, it will be returned to the applicant with reasons for denial and conditions for <br /> compliance. <br /> C. Approval within Thirty Days. Final binding site plan shall be approved, disapproved, <br /> or returned to the applicant within thirty days from date of filing the final binding site <br /> plan for approval by the city, unless the applicant consents to an extension of such time <br /> period in writing. The thirty-day time period shall not commence to run until the <br /> applicant files with the city all required final binding site plan documents completed to <br /> the satisfaction of the city. <br /> D. Residential Condominium Binding Site Plan Map. If a residential condominium <br /> binding site plan map does not show all of the lots and the applicant proposes that the <br /> binding site plan be developed in divisions, permission to develop in divisions will be <br /> granted by the city under the following conditions: <br /> 1. The division of land is consistent with an approved site plan by the city. Such division <br /> can only take place with the filing of a declaration of condominium under Chapter 64.32 <br /> 27 <br />
