SECTION 24: That Ordinance No. 1671-89 (EMC 19.31.070) which reads in part as follows: Modification of design criteria. An applicant may request a modification of the design criteria contained within the adopting ordinance. The modification request shall be reviewed by the planning commission using Review Process V.B, described in Chapter 42 of this title. Following planning commission consideration of the modification, the recommendation of the planning commission shall be reviewed by the city council. In order to approve a request for modification, it must be found that the requested modification does not alter the character desired for the area and is consistent with the intent of the city council in adopting the design overlay zone classification. A proposed PRD will be reviewed by either the hearing examiner using Review Process III.B, or by the planning commission using Review Process V.B,based upon the following criteria: 1. Review Process V.B—PRD proposals containing more than fifty dwelling units, unless proposed to be developed in conjunction with a plat. 2. Review Process III.B—All PRD proposals not specified in subsection 1 of this section.
