F. The minimum rear setback shall be three (3) feet from the rear lot line. <br /> G. Infill dwellings are allowed a height up to twenty four(24) feet in the R-3H zone and thirty four(34) <br /> feet in the R-4H zone. <br /> Section 16: Clinic and Commercial Construction. New clinic or commercial construction will be <br /> reviewed by the Historical Commission using Section M of the Guidelines. <br /> Section 17: Amendment of Neighborhood Conversation Guidelines. "Neighborhood Conservation <br /> Guidelines," as maintained in the office of the Planning Department' are hereby adopted. The <br /> Guidelines, together with the Historic Overlay Zone Standards, are to be used in the review of <br /> construction and development within designated Historic Overlay Zones. The "Neighborhood <br /> Conservation Guidelines" may be amended as necessary by the Planning Director, following <br /> recommendation from the Historical Commission, to further the goal of preserving the historic character <br /> of the neighborhood. <br /> Section 18: Inventory of Affected Properties. An "Inventory of Properties within the Historic <br /> Overlay Zones" is hereby adopted. This lists the properties within the districts which are historically <br /> significant or which contribute to the historic character of the district. It is to be used to identify those <br /> properties which are subject to the regulations specified in this Ordinance. The "Inventory of Historic <br /> Overlay Zones" may be amended as necessary by the Planning Director, following recommendation from <br /> the Historical Commission. The current "Inventory of Historic Overlay Zone" shall be maintained on <br /> file in the Planning Department. <br /> Section 19: R-3and R-4 Historic Overlay Zoned Properties. Ordinance No. 1671-89 as amended by <br /> Section 37 of Ordinance No. 2397-99 ( EMC 19.06-Special Regulations for Zoning Code Development <br /> Standards Table #6.1) which reads in part as follows: <br /> (8) Twenty-eight feet for any portion of building within fifty feet of lots located in the R-S, R-1, R-2, R- <br /> 1 A, or R-2A zones. In the R-4 and R-5 zones, forty-five feet when located at least fifty feet but less than <br /> two hundred feet from lots located in the R-s. If any section, subsection, clause, phrase or any portion of this ordinance is <br /> for any reason held to be invalid or unconstitutional by the decision of any court of competent <br /> jurisdiction, such decision shall not affect the validity of the remaining portions of this ordinance. The <br /> City Council of the City of Everett hereby declares that it would have adopted this ordinance and each <br /> section, subsection, sentence, clause, phrase or portion thereof irrespective of the fact that any one or <br /> more portions be declared invalid or unconstitutional. <br /> 35 <br />
