Contacting local Tribes, Tribal Employment Rights Offices (TERO) <br /> 2 concerning the subcontracting or supply opportunities in sufficient <br /> 3 time to allow the enterprises to participate effectively; <br /> 4 3. Selection by the Bidder of specific economically feasible units of the <br /> 5 project to be performed by DBEs in order to increase the likelihood of <br /> 6 participation by DBEs even if the Bidder preferred to perform these <br /> 7 Work items as the Prime Contractor; <br /> 8 <br /> 9 4. Advertising by the Bidder in general circulation, trade association <br /> 10 minority and trade oriented, women focus publications, concerning <br /> 11 the subcontracting or supply opportunities; <br /> 12 <br /> 13 5. Providing written notice from the Bidder to a reasonable number of <br /> 14 specific DBEs, identified from the OMWBE Directory of Certified DBE <br /> 15 Firms for the selected subcontracting or material supply Work, in <br /> 16 sufficient time to allow the enterprises to participate effectively; <br /> 17 <br /> 18 6. Follow-up by the Bidder of initial solicitations of interest by contacting <br /> 19 the DBEs to determine with certainty whether they were interested. <br /> 20 Documentation of this kind of action shall include the information <br /> 21 outlined below: <br /> 22 <br /> 23 a. The names, addresses, telephone numbers of DBEs who were <br /> 24 contacted, the dates of initial contact, and whether initial <br /> 25 solicitations of interest were followed-up by contacting the DBEs <br /> 26 to determine with certainty whether the DBEs were interested; <br /> 27 <br /> 28 b. A description of the information provided to the DBEs regarding <br /> 29 the plans, specifications, and estimated quantities for portions of <br /> 30 the Work to be performed; <br /> 31 <br /> 32 c. Documentation of each DBE contacted but rejected and the <br /> 33 reason(s) for that rejection; <br /> 34 <br /> 35 7. Providing, to interested DBEs, adequate information about the plans, <br /> 36 specifications, and requirements for the selected subcontracting or <br /> 37 material supply Work; <br /> 38 <br /> 39 8. Negotiating in good faith with the DBE firms, and not, without <br /> 40 justifiable reason, rejecting as unsatisfactory, Bids that are prepared <br /> 41 by any DBE. The DBEs standing within its industry, membership in <br /> 42 specific groups, organizations, or associations and political or social <br /> 43 affiliations - union vs. non-union employee status - are not legitimate <br /> 44 causes for the rejection or non-solicitation of bids in the Prime <br /> 45 Contractor's efforts to meet the project goal; <br /> 46 <br /> 47 9.
