1 Original Quantity Under runs <br /> 2 In the event that Work committed to a DBE firm as part of the COA under <br /> 3 runs the original planned quantities the Prime Contractor shall <br /> 4 demonstrate a GFE to substitute other DBE COA participation. <br /> 5 <br /> 6 Contractor-Initiated Proposals—General <br /> 7 The Contractor cannot reduce the amount of work committed to a DBE <br /> 8 firm at contract award without good cause and only with written <br /> 9 concurrence from the OEO. Reducing a COA DBE's Work is viewed as a <br /> 10 partial DBE termination, subject to the procedures below. <br /> 11 <br /> 12 DBE Termination <br /> 13 A COA DBE Subcontractor may only be terminated in whole or part with <br /> 14 the approval of the Contracting Agency (in coordination with OEO). <br /> 15 Approval will be granted provided the Prime Contractor demonstrates that <br /> 16 the termination is based on good cause. <br /> 17 <br /> 18 Good cause typically includes situations where the DBE Subcontractor is <br /> 19 unable or has failed to perform the work of its subcontract in accordance <br /> 20 with normal industry standards. While not all inclusive, some examples of <br /> 21 good cause include the following circumstances: <br /> 22 <br /> 23 Good cause may exist if: <br /> 24 <br /> 25 • The listed DBE Subcontractor fails or refuses to execute a <br /> 26 written contract. <br /> 27 <br /> 28 • The listed DBE Subcontractor fails or refuses to perform the <br /> 29 work of its subcontract in a way consistent with normal <br /> 30 industry standards. <br /> 31 <br /> 32 • The listed DBE Subcontractor fails or refuses to meet the <br /> 33 Prime Contractor's reasonable, nondiscriminatory bond <br /> 34 requirements. <br /> 35 <br /> 36 • The listed DBE Subcontractor becomes bankrupt, insolvent, <br /> 37 or exhibits credit unworthiness. <br /> 38 <br /> 39 • The listed DBE Subcontractor is ineligible to work on public <br /> 40 works projects because of suspension and debarment <br /> 41 proceedings pursuant 2 CFR Parts 180, 215 and 1,200 or <br /> 42 applicable state law. <br /> 43 <br /> 44 • The listed DBE Subcontractor voluntarily withdraws from the <br /> 45 project and provides to you written notice of its withdrawal. <br /> 46 <br /> 47 • The listed DBE is ineligible to receive DBE credit for the type <br /> 48 of work required. <br /> 49 <br /> HAWTHORNE ELEMENTARY <br /> SAFE ROUTES TO SCHOOL <br /> FED AID#SRTS-0420(021); COE#3540 SP-47 March 16,2016 <br />
