1 <br /> 2 1-07.18(5)D Coverage for Working On, Over, or Near Navigable Waters <br /> 3 If contract involves work on or adjacent to navigable water, as defined by the <br /> 4 U.S. Department of Labor, then the Contractor shall provide proof of insurance <br /> 5 coverage in compliance with the statutory requirements of the U.S. Longshore <br /> 6 and Harbor Workers' Compensation Act (administered by the U.S. Department <br /> 7 of Labor). <br /> 8 If the Contractor is working from barges or any other watercraft, owned or non- <br /> 9 owned, the Contractor must maintain Protection and Indemnity (P&I) <br /> 10 insurance providing coverage for actions of the crew to third parties to the <br /> 11 same limits stated under Section 1-07.18(5)A for Commercial General Liability <br /> 12 Insurance. The Contractor must also provide proof of insurance coverage in <br /> 13 compliance with the statutory requirements of the Merchant Marine Act of <br /> 14 1920 (the "Jones Act"). <br /> 15 <br /> 16 1-07.18(5)F Excess or Umbrella Liability <br /> 17 The Contractor shall provide Excess or Umbrella Liability coverage at limits of <br /> 18 $1,000,000 per occurrence and annual aggregate. This excess or umbrella <br /> 19 liability coverage shall apply, at a minimum, to both the Commercial General <br /> 20 and Auto insurance policy coverage. <br /> 21 This requirement may be satisfied instead through the Contractor's primary <br /> 22 Commercial General and Automobile Liability coverage, or any combination <br /> 23 thereof. <br /> 24 <br /> 25 1-07.18(5)G Pollution Liability <br /> 26 The Contractor shall provide a Pollution Liability policy, providing coverage for <br /> 27 claims involving bodily injury, property damage (including loss of use of <br /> 28 tangible property that has not been physically injured), cleanup costs, <br /> 29 remediation, disposal or other handling of pollutants, including costs and <br /> 30 expenses incurred in the investigation, defense, or settlement of claims arising <br /> 31 out of: <br /> 32 • Contractor's operations related to this project; and/or <br /> 33 • Remediation, abatement, repair, maintenance or other work with lead- <br /> 34 based paint or materials containing asbestos; and/or <br /> 35 • Transportation of hazardous materials away from any site related to this <br /> 36 project. <br /> 37 • Such Pollution Liability policy shall provide the following minimum coverage: <br /> $2,000,000 l each loss and annual aggregate <br /> 38 <br /> 39 1-07.18(5)H Professional Liability <br /> 40 The Contractor and/or its Subcontractor and/or its design consultant providing <br /> 41 construction management, value engineering, or any other design-related non- <br /> 42 construction professional services shall provide evidence of Professional <br /> 43 Liability insurance covering professional errors and omissions.
