ORDINANCE NO. 2616-02 r'lmt-arr <br /> An Ordinance Amending the Zoning Code Regulations for <br /> Changing Electronic Message Signs, Establishing Regulations and <br /> Amending Ordinance No. 1671-89, as amended, (Title 19 EMC ) <br /> WHEREAS, the City did adopt Ordinance No.1671-89 establishing a new Zoning <br /> Code which became effective on January 13, 1990; and <br /> WHEREAS, said Ordinance established regulations for the installation and the <br /> illumination of signs; and <br /> WHEREAS, said Ordinance prohibits signs which have blinking, flashing or fluttering <br /> lights, or other illumination devices which have a changing light intensity or <br /> brightness, or which are so constructed and operated as to create an appearance or <br /> illusion of writing or printing, except for changing message signs; and <br /> WHEREAS, said Ordinance does not define the phrase "changing message sign"; <br /> and <br /> WHEREAS, the Planning Commission held several public workshops and hearings to <br /> gather public testimony and review the standards and regulations related to <br /> electronic changing message signs; and <br /> WHEREAS, the Planning Commission has recommended that the City Council <br /> amend the Zoning Code to add a definition for electronic changing message signs, <br /> and also amend the standards related to the illumination and operation of said <br /> electronic changing message signs; and <br /> WHEREAS, the City Council held a public hearing and took public testimony to <br /> review the standards and regulations related to electronic changing message signs; <br /> and <br /> WHEREAS, the City Council finds that regulations set forth in this ordinance for <br /> electronic changing message signs are necessary and should be adopted due to the <br /> following: <br />
