1. The City continuously receives applications for electronic changing message <br /> signs and the Zoning Code does not define the phrase "changing message sign;" <br /> and <br /> 2. There is a need to have regulations that specifically address the issues related to <br /> changing message signs; and <br /> 3. There is an immediate need for such regulations and the City Council finds the <br /> proposed regulations appropriately address the need; and <br /> 4. The City Council considered the Planning Commission recommendation, held a <br /> public hearing on these regulations, and based on testimony at the City Council <br /> public hearing determined that revisions to the Planning Commission <br /> recommendation were appropriate, and authorized the adoption of these <br /> regulations following the public hearing; and <br /> WHEREAS, the City Council finds that the proposed revision to the Zoning Code <br /> regulations for electronic changing message signs is consistent with the applicable <br /> provisions of the Everett general plan, bears a substantial relation to public health, <br /> safety or welfare and promotes the best long-term interests of the Everett community; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1. Section 4.020 of Ordinance No.1671-89, as amended (EMC 19.04.020, <br /> is hereby amended by the addition of the following Definition: <br /> "Electronic Changing Message Sign" means an electrically activated sign <br /> whose message content, either in whole or in part, may be changed by means <br /> of electronic programming. These signs shall include those displaying time, <br /> temperature, and messages of a public or commercial nature. <br /> Section 2. Section 4.020 of Ordinance No.1671-89, as amended (EMC 19.04.020, <br /> is hereby amended by the addition of the following Definition: <br /> "Video Board" means an electronically activated sign that creates the effect of <br /> motion or animation, except as allowed by this chapter for changing electronic <br /> message signs which are in compliance with the 2-1-2 provision, and the <br /> prohibition of RGB technology. <br /> 2 <br />
