I <br /> 1 in whole or in part, the Owner's Representative will make an adjustment of Contract Sum <br /> 2 or Contract Time required for the work, or both. If the Owner's Representative finds the <br /> 3 Contract Claim to be without merit, no adjustment will be made. <br /> 4 <br /> 5 The Contractor shall keep full, complete, accurate and contemporaneous records of the <br /> 6 costs and additional time incurred for any Contract Claim. The Contractor shall permit <br /> 7 the Owner's Representative to have access to those records and any other records as <br /> 8 may be required by the Owner's Representative to determine the facts or contentions <br /> 9 involved in the Contract Claim. Owner is not obligated to respond to a Contract Claim <br /> 10 unless the Contractor is in full compliance with all the provisions of the Contract <br /> 11 Documents and the formal Contract Claim document has been submitted <br /> 12 <br /> 13 Full compliance by the Contractor with the provisions of this section is a contractual <br /> 14 condition precedent to the Contractor's right to sue or seek any recovery against the <br /> 15 Owner in any legal proceeding. <br /> 16 <br /> 17 1-09.11(2)(B) Contents <br /> 181 <br /> 19 All Contract Claims filed by the Contractor shall be in writing, verified under penalty of <br /> 20 perjury by an officer or principal of the Contractor, and in sufficient detail to enable the <br /> 21 Owner's Representative to ascertain the basis and amount of the Contract Claim. All <br /> 22 Contract Claims shall be submitted to the Owner's Representative. At a minimum, each <br /> 23 Contract Claim must include: <br /> 24 1. A detailed factual statement of the Contract Claim for additional compensation <br /> I <br /> 25 and extension of Contract Time, if any, providing all necessary dates, locations, <br /> 26 and items of work affected by the Contract Claim. <br /> 27 2. The dates of all facts related to the Contract Claim. I <br /> 28 3. The name of each Owner's individual, official, or employee involved in or <br /> 29 knowledgeable about the Contract Claim. <br /> 30 4. The specific provisions of the Contract that support the Contract Claim and a I <br /> 31 statement of the reasons why such provisions support the Contract Claim. <br /> 32 5. If the Contract Claim relates to a decision of the Owner's Representative that the <br /> 33 Contract leaves to the Owner's Representative's discretion or as to which the <br /> 34 Contract provides that the Owner Representative's decision is final, the <br /> 35 Contractor shall set out in detail all facts supporting its position relating to the <br /> 36 decision of the Owner's Representative. <br /> 37 6. Identification of any documents and the substance of any oral communications <br /> 38 that support the Contract Claim. <br /> 39 7. Copies of any identified documents that support the Contract Claim, other than <br /> 40 Owner documents and documents previously furnished to the Owner by the <br /> 41 Contractor. Standard industry manuals may be incorporated by reference. <br /> 42 8. If Contractor seeks an extension of Contract Time: <br /> 43 a. The specific amount of time (including days and dates) sought. <br /> 44 b. The specific reasons the Contractor believes an extension of Contract Time <br /> 45 should be granted, including, but not limited to, compliance with the <br /> 46 requirements of section 1-08.3 Progress Schedule and section 1-08.8 <br /> 47 Extensions of Time; and <br /> 48 c. The specific provisions of the Contract Documents under which it is sought. <br /> 49 9.
