I <br /> 1 a. Labor <br /> I2 b. Materials <br /> 3 c. Direct Equipment. The actual cost for each piece of Equipment for which a <br /> 4 Contract Claim is made or in the absence of actual cost, the rates established <br /> 111 5 by the AGC/WSDOT Equipment Rental Agreement that was in effect when <br /> 6 the work was performed. In no case shall the amounts sought or paid for <br /> 7 each piece of Equipment exceed the rates established by the Equipment <br /> I 8 Rental Agreement even if the actual cost for such Equipment is higher. The <br /> 9 Owner may audit the Contractor's cost records to determine actual <br /> 10 Equipment cost. The following information shall be provided for each piece of <br /> Ii 1 Equipment: <br /> 12 1. Detailed description (e.g., Motor Grader Diesel Powered Caterpillar 12 <br /> 13 "G", Tractor Crawler ROPS & Dozer Included Diesel, etc.) <br /> 14 2. The hours of use or standby; and <br /> 15 3. The specific day and dates of use or standby; <br /> 16 4. Job overhead. <br /> 17 5. Overhead (general and administrative). <br /> 18 6. Subcontractor's Contract Claims (in the same level of detail as specified <br /> I 19 herein is required for any subcontractor's Contract Claims); and <br /> 20 7. Other categories as specified by the Contractor or the Owner. <br /> 21 10. A notarized statement shall be submitted to the Owner's Representative <br /> I 22 containing the following language: <br /> 23 Under the penalty of law for perjury or falsification, the undersigned, <br /> 24 <br /> I 25 <br /> 26 (name) (title) <br /> 27 of <br /> I 28 (company) <br /> 29 hereby certifies that the Contract Claim for extra compensation and extension of Contract <br /> 30 Time, if any, made herein for work on this Contract is a true and complete statement of <br /> 31 the factual basis of the Contract Claim and all actual costs incurred and time sought, and <br /> I 32 is fully documented and supported under the Contract between the parties. <br /> 33 Date /s/ <br /> 34 Subscribed and sworn before me this day of <br /> I 35 Notary Public <br /> 36 My Commission Expires: <br /> 37 <br /> I 38 1-09.11(2)(A) False Or Omitted Information <br /> 39 <br /> 40 The Contractor waives each Contract Claim for which it presents material information <br /> I 41 that it knows, or in the exercise of reasonable care should know, is false, or omits or fails <br /> 42 to disclose material information relating to such Contract Claim.
