1 <br /> 1 Contractor must; <br /> I <br /> 2 1. Affirmatively represent and warrant that the completion of the subject work was <br /> 3 extended and that such extension prevented the performance of other work <br /> 4 during both the period of delay and the later period of time required to complete <br /> 5 the extended work, <br /> I <br /> 6 2. Disclose the details of Contractor generated billings and Contractor Overhead <br /> 7 Costs (as hereinafter defined) throughout the actual project performance. The <br /> 8 details of such information should be no less than specific identification of the <br /> 9 sources and amounts of revenue on no greater than a monthly basis and <br /> 10 specific identification of the types and amounts of Contractor Overhead Costs <br /> 11 on no greater than a monthly basis for the actual project duration. I 12 3. <br /> 13 1-09.11A(4)(A)(1)(c) Overabsorbed Overhead <br /> 14 11115 To demonstrate that it did not incur Overabsorbed Overhead in the period following the <br /> 16 delay (section 1-09.11A(4)(A)(1)(5)), the Contractor must: <br /> 17 1. Affirmatively represent and warrant that completion of the delayed work <br /> 18 prevented the performance of other work; <br /> 19 2. Identify the critical resource unavailable for other work due to completion of the <br /> 20 delayed Contract; and <br /> 21 3. Showing that unavailability of this critical resource precluded the performance of <br /> 22 other work. <br /> 23 4. <br /> 24 1-09.11A(5) Inefficiencies <br /> 25 <br /> 26 1-09.11A(5)(A) Adjustment of Contract Sum <br /> 27 <br /> 28 To the extent Contractor is entitled to an increase in Contract Sum because of <br /> 29 inefficiencies or impaired productivity, then any compensation due shall be calculated as <br /> 30 provided in section 1-09.4 Equitable Adjustment. <br /> 31 111 <br /> 32 1-09.11A(5)(B) Adjustment of Contract Time <br /> 33 <br /> 34 To the extent Contractor is entitled to an extension of Contract Time because of <br /> 35 inefficiencies or impaired productivity, then any the extension shall be determined as <br /> 36 provided in sectionl-08.8 Extensions of Time. <br /> 37 <br /> I <br /> 38 1-09.12 Audits <br /> 39 I 40 1-09.12(1) General <br /> 41 <br /> 42 Section 1-09.12(1) is modified to read as follows: <br /> I <br /> 43 <br /> 44 The Contractor's records relating to this Project, including, but not limited to, wage, <br /> 45 payroll, and cost records, shall be open to inspection or audit by representatives of the <br /> 46 Owner during the Project and for a period of not less than six years after the date of <br /> 47 Final Acceptance of the Contract. The Contractor shall retain these records for that <br /> 48 period. The Contractor shall also guarantee that Project records of subcontractors, <br /> 49 suppliers, and lower tier subcontractors, including, but not limited to, the wage, payroll, <br /> I <br /> 50 and cost records, shall be retained and open to similar inspection or audit for the same <br /> 51 period of time. The audit may be performed by employees or representatives of the <br /> 52 Owner or by an auditor chosen by the Owner.
