I 1 1-01.3 Definitions I2 Section 1-01.3 is amended by adding the following: 3 All references in the Standard Specifications to the terms "State", "Department of 4 Transportation", "Washington State Transportation Commission", "Commission", 5 "Secretary of Transportation", "Secretary", "Headquarters", and "State Treasurer" shall 6 be revised to read "Contracting Agency". I 7 All references to "State Materials Laboratory" shall be revised to read "Contracting 8 Agency designated location". 9 The venue of all causes of action arising from the advertisement, award, execution, and I10 performance of the contract shall be in the Superior Court of the County where the 11 Contracting Agency's headquarters are located. 12 Additive: A supplemental unit of work or group of bid items, identified separately in the 13 proposal, which may, at the discretion of the Contracting Agency, be awarded in addition 14 to the base bid. 15 Alternate: One of two or more units of work or groups of bid items, identified separately 16 in the proposal, from which the Contracting Agency may make a choice between 17 different methods or material of construction for performing the same work. 18 Award Date: The date of the formal action by the Everett City Council to accept the 19 lowest responsible and responsive bidder for the work. 20 Bid Opening Date: The date on which the Everett City Clerk publicly opens and reads $ 21 the bids. 22 Change Order: Reference to Change Order shall include all rights of the Owner and 23 Contractor under section 1-04.4 Changes. Agreed Change Orders shall be in the form I24 attached as Exhibit 1. Unilateral Change Orders shall be in the form attached as Exhibit 25 2. I 26 Completion Date: Date on which Project is ready for Final Acceptance. All physical 27 work, including Punch List, is complete and Contractor has completed and fulfilled all 28 contractual obligations except any maintenance of landscaping. Contractual obligations I 29 that must be fulfilled prior to achievement of the Completion Date include, but are not 30 limited to, the Contractor's furnishing all documentation (including correct, complete and 31 accurate as-built or record drawings) and operation and maintenance manuals and 32 transfer of warranties. 1 33 Contract Claim: Any request by the Contractor for additional time or money 34 (adjustment of Contract Sum or Contract Time) irrespective of the cause or reason for I 35 the request. Contract Claims include, but are not limited to, requests by the Contractor 36 for additional time or money due to Extra Work, inefficiencies, delays, interferences, and 37 problems with the design. Contract Claim includes, but is not limited to, claims or 38 requests by subcontractors for extensions of Contract Time, adjustment of Contract I39 Sum, additional compensation that the Contractor attempts to pass through or assert 40 against the Owner, or claims against the Owner arising out of a third party's claim 41 against the Contractor. Contract Time The period of time 43 established by the terms and conditions of the contract within which the work must be 44 physically completed.
