I <br /> 1 1-01.3 Definitions <br /> I2 Section 1-01.3 is amended by adding the following: <br /> 3 All references in the Standard Specifications to the terms "State", "Department of <br /> 4 Transportation", "Washington State Transportation Commission", "Commission", <br /> 5 "Secretary of Transportation", "Secretary", "Headquarters", and "State Treasurer" shall <br /> 6 be revised to read "Contracting Agency". <br /> I 7 All references to "State Materials Laboratory" shall be revised to read "Contracting <br /> 8 Agency designated location". <br /> 9 The venue of all causes of action arising from the advertisement, award, execution, and <br /> I10 <br /> performance of the contract shall be in the Superior Court of the County where the <br /> 11 Contracting Agency's headquarters are located. <br /> 12 Additive: A supplemental unit of work or group of bid items, identified separately in the <br /> 13 proposal, which may, at the discretion of the Contracting Agency, be awarded in addition <br /> 14 to the base bid. <br /> 15 Alternate: One of two or more units of work or groups of bid items, identified separately <br /> 16 in the proposal, from which the Contracting Agency may make a choice between <br /> 17 different methods or material of construction for performing the same work. <br /> 18 Award Date: The date of the formal action by the Everett City Council to accept the <br /> 19 lowest responsible and responsive bidder for the work. <br /> 20 Bid Opening Date: The date on which the Everett City Clerk publicly opens and reads <br /> $ 21 the bids. <br /> 22 Change Order: Reference to Change Order shall include all rights of the Owner and <br /> 23 Contractor under section 1-04.4 Changes. Agreed Change Orders shall be in the form <br /> I24 attached as Exhibit 1. Unilateral Change Orders shall be in the form attached as Exhibit <br /> 25 2. <br /> I 26 Completion Date: Date on which Project is ready for Final Acceptance. All physical <br /> 27 work, including Punch List, is complete and Contractor has completed and fulfilled all <br /> 28 contractual obligations except any maintenance of landscaping. Contractual obligations <br /> I 29 that must be fulfilled prior to achievement of the Completion Date include, but are not <br /> 30 limited to, the Contractor's furnishing all documentation (including correct, complete and <br /> 31 accurate as-built or record drawings) and operation and maintenance manuals and <br /> 32 transfer of warranties. <br /> 1 33 Contract Claim: Any request by the Contractor for additional time or money <br /> 34 (adjustment of Contract Sum or Contract Time) irrespective of the cause or reason for <br /> I 35 the request. Contract Claims include, but are not limited to, requests by the Contractor <br /> 36 for additional time or money due to Extra Work, inefficiencies, delays, interferences, and <br /> 37 problems with the design. Contract Claim includes, but is not limited to, claims or <br /> 38 requests by subcontractors for extensions of Contract Time, adjustment of Contract <br /> I39 Sum, additional compensation that the Contractor attempts to pass through or assert <br /> 40 against the Owner, or claims against the Owner arising out of a third party's claim <br /> 41 against the Contractor. <br /> I42 Contract Documents: See definition for "Contract". Contract Time The period of time <br /> 43 established by the terms and conditions of the contract within which the work must be <br /> 44 physically completed. <br /> I45 Contract Execution Date: The date the City of Everett officially binds the Contractor to <br /> 46 the contract. <br /> I <br /> IRIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 9 <br />
