I <br /> 1 Contract Sum: The price in dollars stated in the Contract to be paid by the Owner to <br /> 2 the Contractor for the Work described in the Contract Documents, as modified by any <br /> 3 Change Orders. <br /> 4 Delay: Any increase of the duration of the critical path of the Project. <br /> 5 Dispute: Any controversy or disagreement. <br /> 6 Engineer Any and all provisions in the Contract Documents that state the Engineer <br /> 7 "shall" or"will" shall be deemed to mean that the Engineer shall or will take such action if <br /> 8 requested in writing by the Contractor. <br /> 9 Equipment: Mechanical, electrical, instrumentation, or other devices with one or more <br /> 10 moving parts, or devices requiring an electrical, pneumatic, electronic, or hydraulic <br /> 11 connection. <br /> 12 Extended Overhead: The increase in Overhead costs attributable to an extension of <br /> 13 Contract Time. <br /> 14 Extra Work: Providing materials and Equipment and the performance of work not <br /> 15 directly called for in, or implied by, the Contract Documents, such that Contractor would <br /> 16 be entitled to an adjustment of Contract Sum and possibly an extension of Contract <br /> 17 Time. <br /> 18 Final Acceptance: Formal action by Everett City Council determining that all of the I <br /> 19 Contractor's Work has been completed, except for any landscaping maintenance. <br /> 20 Float: The amount of time between the early start date and the late start date, or the <br /> 21 early finish date and the late finish date of any activity in the project schedule. <br /> 22 Force Account: Costs of performing Work as defined in section 1-09.6 Force Account <br /> 23 Furnish: To deliver to the job site or other specified location any item, Equipment, or I <br /> 24 material. <br /> 25 Install: Placing, erecting, or constructing complete in place any item, Equipment, or <br /> 26 material. <br /> 27 May: Conduct that is permitted, but not required. <br /> 28 Notice: A signed, written communication by the Contractor to the Owner as described III <br /> 29 in section 1-04.5 Notice by Contractor. <br /> 30 Notice of Award: The written notice from the City of Everett to the successful bidder <br /> 31 signifying the City's acceptance of the bid. 111 <br /> 32 Notice to Proceed: The written Notice from the Owner or Owner's Representative to <br /> 33 the Contractor authorizing and directing the Contractor to proceed with the Work and <br /> 34 establishing the date on which the Contract Time begins. Multiple and partial Notices to <br /> 35 Proceed may be issued on a single Project. <br /> 36 Over absorbed Overhead: Over recovery of fixed indirect costs that occurs when a t <br /> 37 contractor performs more overall Work than it otherwise would have performed. <br /> 38 Overhead <br /> 39 In general, Overhead for the purpose of calculating additional compensation under this <br /> 40 section of the Contract shall include only those costs that are expended for the <br /> 41 administration of the business as a whole.
