I <br /> 1 made necessary by the Work and for the purpose of maintaining and making repairs to <br /> I 2 their property. <br /> 3 <br /> 4 1-04.3(3)(C)(2) Known Utilities <br /> I 5 <br /> 6 The Contractor shall provide at its sole expense all labor, Equipment, materials and <br /> 7 services necessary to remove, relocate, or maintain utilities specified on the drawings. <br /> 8 The work on each utility shall be performed in a manner satisfactory to the utility owner. <br /> j 9 The utility owner has the option of doing such work with its own forces at the <br /> 10 Contractor's expense, or permitting the work to be performed by the Contractor. <br /> 1 11 <br /> 12 1-04.3(3)(C)(3) Service Connections <br /> 13 <br /> 14 Locations of service connections are not identified on the drawings. The Contractor <br /> I15 shall provide at its sole expense all labor, Equipment and material to remove, relocate or <br /> 16 maintain service connections. Work on service connections shall be performed in a <br /> 17 manner satisfactory to the service connection owner. The service connection owner has <br /> I 18 the option of doing such work with its own force at the Contractor's expense, or <br /> 19 permitting the work to be performed by the Contractor. <br /> 20 <br /> 1 21 1-04.3(3)(C)(4) Unknown Utilities <br /> 22 <br /> 23 When a utility interferes with the Work and is either (1) not identified on the drawings or <br /> 1 24 (2) located in a position significantly different from that specified on the drawings, <br /> 25 Contractor shall follow the procedures of section 1-04.7 Differing Site Conditions <br /> 26 (Changed Conditions). Interference with the Work is defined as a utility that crosses or <br /> I 27 Projects into the plane of the Work at an elevation between the top and bottom of the <br /> 28 work. If it is necessary to remove, relocate, or temporarily maintain the utility, that work <br /> 29 shall be included in a Change Order. The utility owner has the option of doing such work <br /> 30 or permitting the work to be performed by the Contractor. In either case, the cost of the <br /> 31 work incurred by or charged to the Contractor will be included in a Change Order. <br /> 32 <br /> 33 1-04.4 Changes <br /> I34 Section 1-04.4 is modified to read as follows: ' <br /> 35 <br /> I 36 1-04.4(1) Owner's Right to Direct Changes to the Work <br /> 37 <br /> 38 The Owner reserves the right to change the Work at any time. Such changes shall not <br /> I 39 invalidate the Contract nor release the surety, and the Contractor agrees to perform the <br /> 40 Work as changed. Among others, these changes and alterations may include: <br /> 41 1. Deleting or omit any part of the work, Equipment and/or material to be provided <br /> 42 under this Contract, and <br /> 43 2. Increasing or decreasing quantities, <br /> 44 3. Altering Specifications, designs, or both, <br /> 45 4. Altering the way the work is to be done, <br /> I 46 5. Adding new work or Extra Work, <br /> 47 6. Altering facilities, Equipment, materials, services, or sites, provided by the <br /> 48 Owner, and <br /> I 49 7.
