I <br /> 1 <br /> 2 1-04.3(3)(6) Conflicting ProvisionsI <br /> 3 <br /> 4 Figure dimensions on drawings shall govern over scale dimensions and detail drawings <br /> 5 shall govern over general drawings. In the event an item of Work is described differently <br /> 6 in two or more locations on the drawings and in the Specifications, the Contractor shall, <br /> 7 upon request of the Owner's Representative, submit in writing to the Owner's <br /> 8 Representative the description upon which the Contractor relied in preparing its bid or <br /> 9 laying out the Work. If the Owner's Representative directs the Contractor to perform <br /> 10 Work in a manner other than that contemplated by the Contractor in preparing its bid or <br /> 11 laying out the Work, either party may request an equitable adjustment of Contract Sum 1 <br /> 12 or Contract Time. In this event, the Contractor shall give Notice to the Owner's <br /> 13 Representative of such request and provide such supporting information, including <br /> 1 <br /> 14 bidding or layout documents, as may reasonably be necessary for the Owner's <br /> 15 Representative to determine whether the Contract Sum should be increased, decreased <br /> 16 or left unchanged. <br /> 17 I 18 1-04.3(3)(C) Utilities <br /> 19 <br /> 20 1-04.3(3)(C)(1) General <br /> 21 <br /> 22 The Owner has endeavored to determine the existence of utilities at the site of the Work <br /> 23 from the records of the Owners of known utilities in the vicinity of the Work. The <br /> 24 positions of these utilities as derived from such records are shown on the drawings. <br /> 25 Unless otherwise noted, no excavations were made to verify the locations shown for <br /> 26 underground utilities. The service connections to these utilities are not shown on the <br /> 27 drawings. It shall be the responsibility of the Contractor to determine the exact location i <br /> 28 of utilities and service connections thereto. Such field verification must be performed in <br /> 29 sufficient time so as not to impede the progress of the Work or fabrication of materials to <br /> 30 be incorporated into the Work. The Contractor shall call the Utility Location Request <br /> 31 Center (one call center) for location of utilities in the field not less than two (2) nor more <br /> 32 than (10) ten business days before the scheduled date of commencement of excavation. <br /> 33 The Contractor shall make its own investigations, including exploratory excavations, to <br /> 34 determine the locations and type of existing utilities, including service connections, prior <br /> 35 to commencing work that could result in damage to such utilities. The Contractor shall <br /> 36 immediately notify the Owner's Representative as to any utility discovered by him in a <br /> 37 different position than shown on the drawings or which is not shown on the drawings. I/ <br /> 38 No excavation shall begin until all known facilities in the excavation areas have been <br /> 39 marked. Contractor shall coordinate its activities with the utility provider. Contractor <br /> 40 shall bear the cost of maintaining utility service. <br /> 41 <br /> 42 The Contractor should be aware of, and comply with, RCW Chapter 19.122, a law <br /> 43 relating to underground utilities. The Owner shall not pay Contractor any of Contractor's <br /> 44 cost of complying with this law, and repairing or indemnifying any damage or injury <br /> 45 arising out of Contractor's failure to comply with this law. <br /> 46 <br /> 47 Owner does not represent or warrant who may be obligated to pay for the cost of <br /> 48 relocation or temporary maintenance of the utility. Contractor shall investigate whether <br /> 49 such cost must be borne by the owner of the utility. <br /> 50 <br /> 51 Governmental agencies and owners of utilities reserve the right to enter upon streets, <br /> 52 alleys, rights-of-way, or easements for the purpose of making changes in their property <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 18 <br />
