I <br /> 1 industrial insurance and medical aid required under Title 51 RCW. <br /> 2 <br /> 3 Failure of the Contractor to perform all of the Contractor's obligations under the contract <br /> 4 shall not bar the City from unilaterally certifying the contract complete so the Engineer <br /> 5 may calculate a final contract price as provided in Section 1-09.9. <br /> 6 <br /> 7 1-05.13 Superintendents, Labor and Equipment of Contractor <br /> 8 I 9 Revise the seventh paragraph to read: <br /> 10 <br /> 11 Whenever the Contracting Agency evaluates the Contractor's qualifications pursuant to <br /> 12 Section 1-02.1, it will take these performance reports into account. <br /> 13 <br /> 14 1-05.14 Cooperation With Other Contractors <br /> 15 <br /> 16 Section 1-05.14 is modified by adding the following: <br /> 17 <br /> 18 Nothing in the contract shall be interpreted as granting to the Contractor exclusive <br /> 19 occupancy of the project area. The Contractor must ascertain to its own satisfaction the <br /> 20 scope of the project and the nature of any other contracts that have been or may be <br /> 21 awarded by the City in the construction of the project, or to the end that the Contractor11 <br /> 22 may perform this contract in the light of such other contracts, if any. <br /> 23 <br /> 24 The Contractor shall not cause any unnecessary hindrance or delay to any others <br /> 25 working on this or any other project. If the performance of any contract for the project is <br /> 26 likely to be interfered with by the simultaneous performance of some other contract or <br /> 27 contracts, the Engineer will decide which Contractor shall cease work temporarily and <br /> 28 which Contractor shall continue, or whether the work under the contracts can be <br /> 29 coordinated so that the contractors may proceed simultaneously. On all questions <br /> 30 concerning conflicting interest of contractors performing related work, the decision of the <br /> 31 Engineer shall be binding upon all contractors concerned and the City, the Engineer, the <br /> 32 City's Representative, and their consultants shall not be responsible for any damages <br /> 33 suffered or extra costs incurred by the Contractor resulting directly or indirectly from the <br /> 34 award or performance or attempted performance of any other contract or contracts on <br /> 35 the project or caused by a decision or omission of the Engineer respecting the order of <br /> 36 precedence in the performance of the contracts. <br /> 37 I 38 If, through acts of neglect on the part of the Contractor, any others suffer loss or damage <br /> 39 on the Work, the Contractor agrees to resolve such loss or damage fairly and <br /> 40 expeditiously. If such other shall assert any claim against the City, the Engineer, the <br /> 41 City's Representative, or their consultants on account of any damage alleged to have <br /> 42 been so sustained, the City shall notify the Contractor, who shall hold harmless, <br /> 43 indemnify, and defend the City, Engineer, the City's Representative, and their I <br /> 44 consultants, and each of their directors, officers, employees, and agents against any <br /> 45 such claim, including all attorney's fees and any other costs incurred by the indemnified <br /> 46 parties relative to any such claim. 11147 <br /> 48 The Contractor shall coordinate its work with other contractors and utility companies that <br /> 49 may have facilities in the project area and cooperate with them. He shall also coordinate <br /> 50 its activities with the City; and no water mains, individual water services, street, or <br /> 51 private driveways may be closed off without a minimum of 5 working days notice to the <br /> 52 City and the private property owner. Should the property owner or the City have <br /> 53 adequate reason, as determined by the Engineer, to avoid access or water service I <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 34 1 <br />
