I 1 work and dispose of its materials in such a manner as to not interfere with the activities of the I 2 Owner or of others upon the site of work. The Contractor shall promptly make good any 3 Contractor-caused injury or damage to persons or property that may be sustained by other 4 contractors or employees of the Owner. The Contractor shall join its work to that of others and 5 perform its work in proper sequence in relation to that of others. I6 7 If requested by the Contractor, the Owner will arrange meetings with other contractors performing 8 work on behalf of the Owner to plan coordination of construction activities. The Contractor shall I 9 10 inform itself of the planned activities of other contractors and will coordinate its work with the other contractors. 11 12 Contractor shall notify the Owner of problems, interference or any difficulty with other contractors I 13 or workers engaged by the Owner. The Notice shall be sufficiently prompt and specific so as to 14 allow the Owner to mitigate or avoid increased costs, time of performance, damages or injury. 15 Contractor's failure to provide such Notice in a timely way shall be deemed a waiver and release 16 of any and all Contract Claims relating to, arising out of, or caused by, any alleged interference, 17 difficulty or problem with another contractor or worker engaged by the Owner. 18 I 19 1-06A MATERIAL, EQUIPMENT, WORKMANSHIP AND 20 CONSTRUCTION UTILITIES 21 I 22 1-06A.1 General 23 24 Unless otherwise specifically stated in the Contract Documents, the Contractor shall I 25 provide and pay for materials, labor, tools, Equipment, water, light, power, 26 transportation, supervision, and temporary construction of any nature, and other services 27 and facilities of any nature, whatsoever necessary, to execute, complete and deliver the I 28 work within the specified time. Contractor shall be liable for all power and water costs 29 until Substantial Completion, whether such power or water is provided by temporary or 30 permanent facilities. Owner shall not be liable for any costs or Delays arising out of or 31 caused by the availability or lack of availability of permanent power or utilities. Material I32 and Equipment shall be new and of the specified quality. Equipment offered shall be 33 new or current specified models. This requirement does not apply to minor details, or to 34 thoroughly demonstrated improvements in design or in materials of construction. I 35 Construction work shall be executed in conformity with the standard practice of the 36 trade. 37 I 38 1-06A.2 Product Data 39 40 When specified, the Contractor shall provide data required for inspecting, testing, I 41 42 operating, or maintaining parts of the work. Unless otherwise specified, such data shall be provided at the time the referenced material or Equipment is delivered to the job site. 43 The data shall be as specified and shall include, unless otherwise specified, such items I 44 as shop drawings, erection drawings, reinforcing steel schedules, testing and adjusting 45 instructions, operations manuals, maintenance procedures, parts lists, and record 46 drawings. Such data shall be provided as part of the work under this Contract and its 47 acceptability determined by the Owner in its sole discretion. I 48 49 1-06A.3 Quality 50 I 51 Where detailed Specifications of materials, Equipment, or construction work are not set 52 forth, the Contractor shall perform the work using materials and Equipment of a quality 53 comparable to the materials and workmanship specified for the other parts of the work, I54 from firms of established good reputations, and shall follow standard practices to IRIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 39
