I <br /> 1 work and dispose of its materials in such a manner as to not interfere with the activities of the <br /> I 2 Owner or of others upon the site of work. The Contractor shall promptly make good any <br /> 3 Contractor-caused injury or damage to persons or property that may be sustained by other <br /> 4 contractors or employees of the Owner. The Contractor shall join its work to that of others and <br /> 5 perform its work in proper sequence in relation to that of others. <br /> I6 <br /> 7 If requested by the Contractor, the Owner will arrange meetings with other contractors performing <br /> 8 work on behalf of the Owner to plan coordination of construction activities. The Contractor shall <br /> I 9 <br /> 10 inform itself of the planned activities of other contractors and will coordinate its work with the <br /> other contractors. <br /> 11 <br /> 12 Contractor shall notify the Owner of problems, interference or any difficulty with other contractors <br /> I 13 or workers engaged by the Owner. The Notice shall be sufficiently prompt and specific so as to <br /> 14 allow the Owner to mitigate or avoid increased costs, time of performance, damages or injury. <br /> 15 Contractor's failure to provide such Notice in a timely way shall be deemed a waiver and release <br /> 16 of any and all Contract Claims relating to, arising out of, or caused by, any alleged interference, <br /> 17 difficulty or problem with another contractor or worker engaged by the Owner. <br /> 18 <br /> I 19 1-06A MATERIAL, EQUIPMENT, WORKMANSHIP AND <br /> 20 CONSTRUCTION UTILITIES <br /> 21 <br /> I 22 1-06A.1 General <br /> 23 <br /> 24 Unless otherwise specifically stated in the Contract Documents, the Contractor shall <br /> I 25 provide and pay for materials, labor, tools, Equipment, water, light, power, <br /> 26 transportation, supervision, and temporary construction of any nature, and other services <br /> 27 and facilities of any nature, whatsoever necessary, to execute, complete and deliver the <br /> I 28 work within the specified time. Contractor shall be liable for all power and water costs <br /> 29 until Substantial Completion, whether such power or water is provided by temporary or <br /> 30 permanent facilities. Owner shall not be liable for any costs or Delays arising out of or <br /> 31 caused by the availability or lack of availability of permanent power or utilities. Material <br /> I32 and Equipment shall be new and of the specified quality. Equipment offered shall be <br /> 33 new or current specified models. This requirement does not apply to minor details, or to <br /> 34 thoroughly demonstrated improvements in design or in materials of construction. <br /> I 35 Construction work shall be executed in conformity with the standard practice of the <br /> 36 trade. <br /> 37 <br /> I 38 1-06A.2 Product Data <br /> 39 <br /> 40 When specified, the Contractor shall provide data required for inspecting, testing, <br /> I <br /> 41 <br /> 42 operating, or maintaining parts of the work. Unless otherwise specified, such data shall <br /> be provided at the time the referenced material or Equipment is delivered to the job site. <br /> 43 The data shall be as specified and shall include, unless otherwise specified, such items <br /> I <br /> 44 as shop drawings, erection drawings, reinforcing steel schedules, testing and adjusting <br /> 45 instructions, operations manuals, maintenance procedures, parts lists, and record <br /> 46 drawings. Such data shall be provided as part of the work under this Contract and its <br /> 47 acceptability determined by the Owner in its sole discretion. <br /> I 48 <br /> 49 1-06A.3 Quality <br /> 50 <br /> I 51 Where detailed Specifications of materials, Equipment, or construction work are not set <br /> 52 forth, the Contractor shall perform the work using materials and Equipment of a quality <br /> 53 comparable to the materials and workmanship specified for the other parts of the work, <br /> I54 from firms of established good reputations, and shall follow standard practices to <br /> IRIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 39 <br />
