I <br /> 1 Representative shall not relieve the Contractor of its responsibility for errors or lack of <br /> I 2 quality therein and shall not be regarded as an assumption of risks or liability by the <br /> 3 Owner's Representative for the Contractor's compliance with these Contract Documents. <br /> 4 Contractor remains responsible and liable for any and all errors, defects or a lack of <br /> I 5 quality not discovered by inspection or observation. <br /> 6 <br /> 7 If parts of the work are covered prior to inspection or observation, the cost of exposing <br /> I 8 the work for inspection and closing and re-covering shall be borne by the Contractor <br /> 9 regardless of whether the work is found to be in compliance with the Contract. <br /> 10 <br /> 11 1-06A.6(2) Samples of Materials <br /> I 12 <br /> 13 The Contractor shall provide samples or specimens of materials to be incorporated in <br /> 14 the work that require laboratory examination or special testing, as requested by the <br /> I 15 Owner's Representative. Such samples or specimens shall be provided in ample time to <br /> 16 permit making proper test analysis and examinations before the Contractor plans to <br /> 17 incorporate the material into the work. An independent testing laboratory will conduct <br /> I 18 tests of material in accordance with the Specifications. In the absence of a specific test <br /> 19 requirement, the Owner's Representative will determine the appropriate standard test to <br /> 20 be used. <br /> i 21 <br /> 22 1-06A.6(3) Certification <br /> 23 In cases where compliance of materials or Equipment to Contract requirements is not <br /> I 24 readily determinable through inspection and tests, the Contractor shall provide properly <br /> 25 authenticated documents, certificates, or other proof satisfactory to the Owner's <br /> 26 Representative that the materials and Equipment comply with the Contract <br /> 27 requirements. These documents, certifications, and proofs shall include performance <br /> I28 characteristics, construction materials, and physical or chemical characteristics of <br /> 29 materials. The Contractor shall pay all associated costs of such certification. <br /> 30 <br /> I 31 1-06A.6(4) Inspection at Point of Manufacturing <br /> 32 If (a) inspection and testing of materials or Equipment in the vicinity of the Work by the <br /> 33 Owner is not practicable, (b) the Contractor requests the Owner to inspect and test <br /> I 34 material or Equipment at the point of manufacture, or (c) the specifications require that <br /> 35 inspection, testing or witnessing of tests take place at the point of manufacture, the <br /> 36 Contractor shall be responsible and reimburse the Owner for the costs of inspections, if <br /> I 37 inspections occur outside of Whatcom, Skagit, Island, Snohomish, King, Pierce and <br /> 38 Thurston counties. Costs to be paid or reimbursed by the Contractor include, but are not <br /> 39 limited to, travel, subsistence, labor and lodging expenses of the City's inspector. <br /> I 40 <br /> 41 1-06A.6(5) Testing and Commissioning of Completed Work <br /> 42 Testing and commissioning of all mechanical, electrical, and instrumentation systems <br /> 43 and completed portions of the work, functioning as a completed system and the <br /> I44 complete Project, functioning as a completed facility, shall be done in accordance with <br /> 45 the specifications. <br /> 46 <br /> 1 47 1-06A.6(6) Manufacturer's Directions <br /> 48 Manufactured articles, material and Equipment shall be transported, stored, applied, <br /> 49 installed, connected, erected, adjusted, tested, operated and maintained as <br /> I 50 recommended by the manufacturer, unless otherwise specified herein. Manufacturer's <br /> 51 installation instructions and procedures shall be provided to the Owner prior to <br /> 52 installation of the manufactured articles, material and Equipment. <br /> 1 53 <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 41 <br />
