I 1 Representative shall not relieve the Contractor of its responsibility for errors or lack of I 2 quality therein and shall not be regarded as an assumption of risks or liability by the 3 Owner's Representative for the Contractor's compliance with these Contract Documents. 4 Contractor remains responsible and liable for any and all errors, defects or a lack of I 5 quality not discovered by inspection or observation. 6 7 If parts of the work are covered prior to inspection or observation, the cost of exposing I 8 the work for inspection and closing and re-covering shall be borne by the Contractor 9 regardless of whether the work is found to be in compliance with the Contract. 10 11 1-06A.6(2) Samples of Materials I 12 13 The Contractor shall provide samples or specimens of materials to be incorporated in 14 the work that require laboratory examination or special testing, as requested by the I 15 Owner's Representative. Such samples or specimens shall be provided in ample time to 16 permit making proper test analysis and examinations before the Contractor plans to 17 incorporate the material into the work. An independent testing laboratory will conduct I 18 tests of material in accordance with the Specifications. In the absence of a specific test 19 requirement, the Owner's Representative will determine the appropriate standard test to 20 be used. i 21 22 1-06A.6(3) Certification 23 In cases where compliance of materials or Equipment to Contract requirements is not I 24 readily determinable through inspection and tests, the Contractor shall provide properly 25 authenticated documents, certificates, or other proof satisfactory to the Owner's 26 Representative that the materials and Equipment comply with the Contract 27 requirements. These documents, certifications, and proofs shall include performance I28 characteristics, construction materials, and physical or chemical characteristics of 29 materials. The Contractor shall pay all associated costs of such certification. 30 I 31 1-06A.6(4) Inspection at Point of Manufacturing 32 If (a) inspection and testing of materials or Equipment in the vicinity of the Work by the 33 Owner is not practicable, (b) the Contractor requests the Owner to inspect and test I 34 material or Equipment at the point of manufacture, or (c) the specifications require that 35 inspection, testing or witnessing of tests take place at the point of manufacture, the 36 Contractor shall be responsible and reimburse the Owner for the costs of inspections, if I 37 inspections occur outside of Whatcom, Skagit, Island, Snohomish, King, Pierce and 38 Thurston counties. Costs to be paid or reimbursed by the Contractor include, but are not 39 limited to, travel, subsistence, labor and lodging expenses of the City's inspector. I 40 41 1-06A.6(5) Testing and Commissioning of Completed Work 42 Testing and commissioning of all mechanical, electrical, and instrumentation systems 43 and completed portions of the work, functioning as a completed system and the I44 complete Project, functioning as a completed facility, shall be done in accordance with 45 the specifications. 46 1 47 1-06A.6(6) Manufacturer's Directions 48 Manufactured articles, material and Equipment shall be transported, stored, applied, 49 installed, connected, erected, adjusted, tested, operated and maintained as I 50 recommended by the manufacturer, unless otherwise specified herein. Manufacturer's 51 installation instructions and procedures shall be provided to the Owner prior to 52 installation of the manufactured articles, material and Equipment. 1 53 RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 41
