1 1 1-06 CONTROL OF MATERIAL 2 3 1-06.4 Handling and Storing Materials 4 I 5 Section 1-06.4 is modified by adding the following: 6 7 Contractor shall store materials and Equipment so as to insure the preservation of their 8 quality and fitness for the work. Stored Equipment and materials shall be located so as 9 to facilitate inspection. The Contractor shall be responsible for damages, loss or 10 casualty occurring to materials and Equipment until Final Acceptance. 11 I 12 1-07 LEGAL RELATIONS AND RESPONSIBILITIES TO THE PUBLIC 13 I 14 1-07.1 Laws to be Observed 15 16 Section 1-07.1 is modified by adding the following: 17 I 18 The Contractor shall be in compliance with all applicable standards, orders, or 19 requirements issued under Section 306 of the Clear Air Act [42 U.S.C. 1857(h)], Section 20 508 of the Clean Water Act (33 U.S.C. 1368), Executive Order 11738, and 1 21 Environmental Protection Agency Regulations (40 CFR Part 15). (Contracts, 22 subcontracts, and subgrants of amounts in excess of$100,000). 23 24 The Contractor shall comply with mandatory standards and policies relating to energy 25 efficiency which are contained in the state energy conservation plan issued in 26 compliance with the Energy Policy and Conservation Act (Pub. L. 94-163). 27 28 The City advises all general contractors and subcontractors that numerous Federal, 29 State, and Local regulations exist that could affect the procedures used in the 30 completion of this project. The City advises each prospective Contractor that they are 31 responsible to be aware of and comply with all applicable statutes and regulations. It is 32 recommended that each Contractor contact the local office of the following agencies for 33 a list of applicable regulations and requirements that might affect the implementation of 34 this project: 35 36 Federal Environmental Protection Agency 37 Washington Department of Health 38 Washington Department of Ecology 39 Washington Department of Fisheries 40 Washington Department of Wildlife 41 Washington Department of Labor& Industries 42 Puget Sound Air Pollution Control Agency 43 Municipal Building Department 44 Municipal Planning Department 45 Municipal Public Works Department 46 47 If the scope of work in this contract includes work at the City of Everett Water Filter Plant 48 or the Waste Water Pollution control Facility, Contractor must comply with the 49 requirements of the Washington Department of Labor & Industries for such work I 50 including, but not limited to, Chapter 296-67 WAC. All costs associated or incurred in 51 complying with these regulations or any other regulations listed above are considered 52 incidental to the Contract and are included in the Contractor's proposal.
