If the Contractor is delayed due to <br /> 2 acts of omission on the part of the Contracting Agency in obtaining easements, rights of <br /> 3 entry or right of way, the Contractor will be entitled to an extension of time. The <br /> 4 Contractor agrees that such delay shall not be a breach of contract. <br /> 5 <br /> 6 Each property owner shall be given 48 hours notice prior to entry by the Contractor. This <br /> 7 includes entry onto easements and private property where private improvements must <br /> 8 be adjusted. <br /> 9 <br /> 10 The Contractor shall be responsible for providing, without expense or liability to the <br /> 11 Contracting Agency, any additional land and access thereto that the Contractor may <br /> I <br /> 12 desire for temporary construction facilities, storage of materials, or other Contractor <br /> 13 needs. However, before using any private property, whether adjoining the work or not, <br /> 14 the Contractor shall file with the Engineer a written permission of the private property <br /> 15 owner, and, upon vacating the premises, a written release from the property owner of <br /> 16 each property disturbed or otherwise interfered with by reasons of construction pursued <br /> 17 under this contract. The statement shall be signed by the private property owner, or <br /> 18 proper authority acting for the owner of the private property affected, stating that111 <br /> 19 permission has been granted to use the property and all necessary permits have been <br /> 20 obtained or, in the case of a release, that the restoration of the property has been <br /> 21 satisfactorily accomplished. The statement shall include the parcel number, address, I <br /> 22 and date of signature. Written releases must be filed with the Engineer before the <br /> 23 Completion Date will be established. <br /> 24 <br /> 25 1-07.28 Title VI Notice <br /> 26 The City of Everett hereby gives public notice that it is the City's policy to assure full <br /> 27 compliance with Title VI of the Civil Rights Act of 1964, the Civil rights Restoration Act of <br /> 28 1987, and related statutes and regulations in all programs and activities. Title VI requires <br /> 29 that no person shall, on the grounds of race, color, sex, or national origin be excluded <br /> 30 from participation in, be denied the benefits of, or be otherwise subjected to <br /> 31 discrimination under any Federal Aid Highway program or other activity for which the <br /> 32 City receives Federal financial assistance. <br /> 33 <br /> 34 Any person who believes they have been aggrieved by an unlawful discriminatory <br /> 35 practice under Title VI has a right to file a formal complaint with the City of Everett.
