Assistants may include, but are not limited to, survey crews; <br /> 2 personnel from the Contracting Agency's material testing lab; inspectors; and other <br /> 3 Contracting Agency employees when in the opinion of the Engineer, such work <br /> 4 necessitates their presence. <br /> 5 1 6 1-08.0(3) Reimbursement for Overtime Work of Contracting Agency Employees <br /> 7 <br /> 8 Where the Contractor elects to work on a Saturday, Sunday, or holiday, or longer than an <br /> 9 8-hour work shift on a regular working day, as defined in the Standard Specifications, <br /> 10 such work shall be considered as overtime work. On all such overtime work an <br /> 11 inspector will be present, and a survey crew may be required at the discretion of the I 12 Engineer. In such case, the Contracting Agency may deduct from amounts due or to <br /> 13 become due to the Contractor for the costs in excess of the straight-time costs for <br /> 14 employees of the Contracting Agency required to work overtime hours. <br /> 15 <br /> 16 The Contractor by these specifications does hereby authorize the Engineer to deduct <br /> 17 such costs from the amount due or to become due to the Contractor. <br /> 181 <br /> 19 1-08.1 Subcontracting <br /> 20 <br /> 21 Revise the seventh paragraph to read: I <br /> 22 On all projects funded with Contracting Agency funds only, the Contractor shall certify to <br /> 23 the actual amounts paid Disadvantaged, Minority, or Women's Business Enterprise firms <br /> 24 that were used as subcontractors, lower tier subcontractors, manufacturers, regular <br /> I <br /> 25 dealers, or service providers on the contract. This certification shall be submitted to the <br /> 26 Engineer, on the form provided by the Engineer, on 20 calendar days after physical <br /> 27 completion of the contract, whichever comes first. i 28 <br /> 29 Section 1-08.1 is modified by adding the following: <br /> 30 Prior to any subcontractor or lower tier subcontractor beginning work, the Contractor <br /> 31 shall submit to the Engineer a certification (WSDOT Form 420-004) that a written <br /> 32 agreement between the Contractor and the subcontractor or between the subcontractor <br /> 33 and any lower tier subcontractor has been executed. This certification shall also <br /> 34 guarantee that these subcontract agreements include all the documents required by the <br /> 35 Special Provision entitled Federal Agency Inspection. The Contracting Agency will not <br /> 36 approve a subcontractor that is also providing services to the Contracting Agency on the <br /> 37 same project. I <br /> 38 <br /> 39 A subcontractor or lower tier subcontractor will not be permitted to perform any work <br /> 40 under the contract until the following documents have been completed and submitted to <br /> 41 the Engineer: <br /> 42 1. Request to Sublet Work (Form 421-012), and <br /> 43 2. Contractor and Subcontractor or Lower Tier Subcontractor Certification for <br /> 44 Federal-aid Projects (Form 420-004). <br /> 45 <br /> 46 The Contractor's records pertaining to the requirements of this Special Provision shall be <br /> 47 open to inspection or audit by representatives of the Contracting Agency during the life <br /> 48 of the contract and for a period of not less than three years after the date of acceptance <br /> 49 of the contract. The Contractor shall retain these records for that period. The Contractor <br /> 50 shall also guarantee that these records of all subcontractors and lower tier <br /> 51 subcontractors shall be available and open to similar inspection or audit for the same <br /> 52 time period. <br /> 53 <br /> I <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 58 <br /> I <br />
