I <br /> 1 Unless explicitly specified elsewhere in the Contract Documents or expressly authorized <br /> I 2 in writing by the Owner before Contractor submits its proposal or bid, the Contractor <br /> 3 shall perform with its own organization at least one-third of the work by dollar volume <br /> 4 and Contractor shall not sublet to a single contractor more than one-half of the Project. <br /> I 5 A subcontractor of the Contractor shall not sublet to another subcontractor more than <br /> 6 one-half of its work without the written consent of the Owner obtained within twenty (20) <br /> 7 days of award of the Contract to the Contractor. The Owner may refuse to approve such <br /> I 8 subcontract for any reason. Only Unit Price and Schedule of Value items of the Contract <br /> 9 will be used in computing the total work. <br /> 10 <br /> 11 Subcontractors will be considered agents of the Contractor and their work shall be <br /> 12 subject to the provisions of the Contract. References in the Contract Documents to <br /> 13 actions required of subcontractors, manufacturers, suppliers, or any person other than <br /> 14 the Contractor, the Owner or the Owner's Representative shall be interpreted as <br /> I15 requiring that the Contractor shall require such subcontractor, manufacturer, supplier or <br /> 16 person to perform the specified action. <br /> 17 <br /> I 18 Contractor shall comply with RCW 39.04.250 (1992) and RCW 39.76.011 (1992), as <br /> 19 amended, and any successor and other laws, ordinances, and regulations regarding <br /> 20 payment of subcontractors. Contractor shall also comply with the requirements of RCW <br /> I 21 Chap. 60.28 and any other law, ordinance, or regulation relating to the release of <br /> 22 retainage to subcontractors. <br /> 23 <br /> I 24 The Contract Documents shall apply to subcontractors and suppliers as if each had <br /> 25 signed the Contract with the Owner. Contractor shall include the provisions of these <br /> 26 Contract Documents or a "flow down" clause in each contract with subcontractors and <br /> I 27 suppliers. <br /> 28 <br /> 29 1-08.3 Progress Schedule <br /> I 30 Section 1-08.3 is modified to read as follows: <br /> 31 <br /> 32 1-08.3(1) General <br /> 33 Because time is of the essence, diligent and expeditious progress and completion of the <br /> 34 Work by the contract completion date is required of the Contractor. Careful, adequate, <br /> 35 accurate and complete planning and scheduling of the work by the Contractor, both prior <br /> 36 to the start of, and throughout, construction, is vital to the success of this project for both <br /> 37 the Contractor and the City. The purposes of the schedules and reports include: <br /> 38 3. Ensuring adequate planning and execution of the work by the Contractor. <br /> I <br /> 39 <br /> 40 4. Assisting the City, or its representative in monitoring construction. <br /> 5. Assessing the impact of any actual, potential or proposed change, including, but <br /> 41 not limited to, the financial impact resulting from schedule changes and changes <br /> I 42 to the scope of work. <br /> 43 6. Supporting the basis for construction payments. <br /> 44 7. Planning by City and tenants. <br /> I 45 8. Avoiding additional or extra costs or expenses to City. <br /> 46 <br /> 47 All schedules will be reviewed by the City and the City's representative such as an <br /> 48 architect or engineer, if the City employs a representative ("Representative"). Review <br /> I49 shall not constitute approval or acceptance of the Contractor's construction means, <br /> 50 methods, sequencing, logic, order, precedence and succession of activities or <br /> 51 Contractor's ability to complete the Work in a timely manner.
