I <br /> 1 schedule revision demonstrating a plan to make up the lag in progress and insure <br /> I 2 completion of the work within the Contract Time. All actions taken to return the Project <br /> 3 to the accepted schedule are at the Contractor's expense. <br /> 4 <br /> I 5 The Contractor shall pay all costs incurred by the Owner that result from the Contractor's <br /> 6 action to return the Project to its accepted schedule, including, but not limited to, <br /> 7 additional, overtime, or third party inspection, design and construction management <br /> I 8 service costs. Contractor agrees that Owner shall deduct such charges from payments <br /> 9 due the Contractor. It is further understood and agreed that none of the services <br /> 10 performed by the Owner's Representative in monitoring, reviewing and reporting Project <br /> 11 status and progress shall relieve the Contractor of responsibility for planning and <br /> 12 managing construction work in conformance with the construction schedule. <br /> 13 <br /> 14 1-08.5 Time for Completion <br /> I 15 <br /> 16 Section 1-08.5 is modified by adding the following: <br /> 17 <br /> I <br /> 18 The heading, "1-08.5(1) General" is inserted immediately after the heading "1-08.5 Time <br /> 19 for Completion". <br /> 20 <br /> I 21 1-08.5(1) General <br /> 22 <br /> 23 Revise the fourth and fifth paragraphs to read: <br /> I <br /> 24 <br /> 25 Contract time shall begin on the effective date of the Notice to Proceed. The Contract <br /> Provisions may specify another starting date for contract time, in which case, time will <br /> 26 begin on the starting date specified. <br /> I 27 <br /> 28 Each working day shall be charged to the contract as it occurs, beginning on the <br /> 29 effective date of the Notice to Proceed, unless otherwise provided in the Contract <br /> I <br /> 30 <br /> 31 Provisions, until the contract work is physically complete. Each week the Engineer will <br /> provide the Contractor a statement that shows the number of working days: (1) charged <br /> 32 to the contract the week before; (2) specified for the physical completion of the contract; <br /> 33 and (3) remaining for the physical completion of the contract. The statement will also <br /> I 34 show the nonworking days and any partial or whole day the Engineer declares as <br /> 35 unworkable. Within 10 calendar days after the date of each statement, the Contractor <br /> 36 shall file a written protest of any alleged discrepancies in it. To be considered by the <br /> I <br /> 37 Engineer, the protest shall be in sufficient detail to enable the Engineer to ascertain the <br /> 38 basis and amount of time disputed. By not filing such detailed protest in that period, the <br /> 39 Contractor shall be deemed as having accepted the statement as correct. If the <br /> I <br /> 40 <br /> 41 Contractor elects to work 10 hours a day and 4 days a week (a 4-10 schedule) and the <br /> fifth day of the week in which a 4-10 shift is worked would ordinarily be charged as a <br /> 42 working day then the fifth day of that week will be charged as a working day whether or <br /> I <br /> 43 not the Contractor works on that day. <br /> 44 <br /> 45 The following new sections are added: <br /> I 46 <br /> 47 1-08.5(2) Substantial Completion <br /> 48 <br /> I 49 When the Contractor considers the work to be Substantially Complete and ready for its <br /> 50 intended use, it shall give Notice to the Owner's Representative. The Notice shall <br /> 51 include an itemized list of remaining incomplete work. If the Owner's Representative <br /> I52 determines the work is not substantially complete, it will so notify the Contractor in <br /> IRIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 65 <br />
