If the Owner's Representative <br /> I <br /> 2 finds the work substantially complete, it will meet with the Contractor to (1) prepare a <br /> 3 Punch List of incomplete items of work; (2) define the division of responsibility between <br /> 4 Owner and Contractor with respect to security, operation, maintenance, heat, utilities, <br /> 5 insurance, and warranties; and (3) describe any other issues related to acceptance of <br /> I <br /> 6 the substantially completed work. <br /> 7 <br /> 8 If the Owner's Representative is not an employee of the Owner, the Owner's <br /> 9 Representative will write to the Owner upon reaching agreement with the Contractor, <br /> 10 certifying that the work is substantially complete, listing the items of incomplete work, <br /> 11 stating the date for completion of incomplete work, defining the division of <br /> I <br /> 12 responsibilities, and setting forth any other terms related to acceptance. In such event, <br /> 13 the Owner will review the Owner's Representative's certification that the work is <br /> 14 substantially complete. If the Owner concurs, the Owner will notify the Contractor in <br /> 15 writing that the work is accepted as substantially complete. Except for any portion(s) of <br /> 16 work specified for early completion or required by the Owner for early possession, <br /> 17 Substantial Completion will not occur for any work until the entire Project is ready for <br /> I <br /> 18 possession and use. The acceptance Notice will include a Punch List of incomplete <br /> 19 work items and corrective works, set the date for their completion and repair, describes <br /> 20 the division of responsibility between the Owner and Contractor, and describe any other <br /> 21 terms of acceptance. The Contractor will acknowledge receipt of the acceptance Notice <br /> I <br /> 22 in writing, indicating acceptance of all of its terms and provisions. <br /> 23 <br /> 24 Subsequent to the Substantial Completion date, the Owner may exclude the Contractor <br /> I <br /> 25 from the work during such periods when construction activities might interfere with the <br /> 26 intended operation of the Project. The Owner, however, shall allow the Contractor <br /> 27 reasonable access for completion or correction of incomplete Punch List items. I 28 <br /> 29 1-08.5(3) Acceptance of Work <br /> 30 <br /> 31 Upon completion of the Project, including, but not limited to, record drawings, as-builts, <br /> 32 required reports and operations and maintenance manuals, the Contractor shall so notify <br /> 33 the Owner's Representative in writing. Upon receipt of the notification, the Owner's I 34 Representative will promptly, by personal inspection, determine the actual status of the <br /> 35 work in accordance with the terms of the Contract. If the Owner's Representative finds <br /> 36 materials, Equipment, or workmanship that do not meet the terms of the contract, it will <br /> I <br /> 37 prepare a Punch List of such items and submit it to the Contractor. Following completion <br /> 38 of the corrective work by the Contractor, the Owner's Representative will notify the <br /> 39 Owner that the work has been completed in accordance with the Contract. The Owner <br /> 40 shall make the final determination of acceptability and completion. For portions of the <br /> I <br /> 41 Project not previously accepted as substantially complete, the conditions of guarantee <br /> 42 shall commence on the date that the Owner determines the Project is complete. <br /> 43 <br /> I <br /> 44 1-08.6A Suspension Procedures <br /> 45 <br /> 46 The Owner may, at its convenience and at any time and without cause, suspend all or <br /> I <br /> 47 any part of the work by Notice in writing to the Contractor. The work shall be resumed <br /> 48 by the Contractor within five (5) days after receiving Notice from the Owner to do so. <br /> 49 The Contractor will be allowed an increase in the Contract Sum or an extension of I 50 Contract Time, or both, directly attributable to any suspension in accordance with the <br /> 51 Change Order procedures herein; provided, the Contractor shall not be entitled to any <br /> 52 increase to the extent caused by the Contractor. <br /> RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 66 <br /> I <br />
