I <br /> 1 <br /> I 2 1-08.7 Maintenance During Suspension <br /> 3 <br /> 4 Revise the second paragraph to read: <br /> I 5 At no expense to the Contracting Agency, the Contractor shall provide through the <br /> 6 construction area a safe, smooth, and unobstructed roadway, sidewalk, and path for <br /> 7 public use during suspension (as required in Section 1-07.23 or the Special Provisions). <br /> I 8 This may include a temporary road or detour. <br /> 9 <br /> 10 1-08.8 Extensions of Time <br /> I 11 <br /> 12 Section 1-08.8 is modified by adding the following: <br /> 13 <br /> I 14 Any requests for extensions in Contract Time, whether resulting from Extra Work <br /> 15 directed by the Owner or not, shall be accompanied by an analysis of schedules using <br /> 16 the critical path method. This analysis shall include an updated schedule, an as-planned <br /> 17 schedule, an as-built schedule, a but-for schedule, and narrative explaining the alleged <br /> I18 causes, schedule impacts and all costs related to or arising out of the proposed <br /> 19 extension. Any requests for extensions of Contract Time by the Contractor shall be <br /> 20 submitted in accordance with these Contract Documents. Extensions of Contract Time <br /> 21 will be granted only as provided in the Contract Documents and to the extent that <br /> 22 affected critical activities exceed the Total Float time along the affected paths of the <br /> 23 reviewed Preliminary Schedule at the time the change was authorized in writing by the <br /> I 24 Owner. Contractor has the burden of clearly and convincingly demonstrating entitlement <br /> 25 to any adjustment of Contract Time. <br /> 26 <br /> I 27 If the City is solely responsible for any Delay to Substantial Completion, Physical <br /> 28 Completion, Completion Date, or Final Acceptance, the Contractor shall only be entitled <br /> 29 to compensation or other damages as described in section 1-09A Remedies, provided <br /> I <br /> 30 <br /> 31 that Contractor timely gave Notice pursuant to section 1-04.5 Notice by Contractor, <br /> timely submitted a Contract Claim pursuant to section 1-09.11(2) Claims and fulfilled the <br /> 32 requirements of section 1-08.3 Progress Schedule. <br /> 33 <br /> I34 1-08.9 Liquidated Damages <br /> 35 <br /> 36 Section 1-08.9 is modified as follows: <br /> I37 <br /> 38 T = original time for physieal substantial completion <br /> 39 <br /> I 40 Section 1-08.9 is modified by deleting the following: <br /> 41 <br /> 42 For overruns in contract time occurring after the substantial completion date, <br /> I 43 <br /> 44 --- - - - - - - - -- -- - -- -- -- ' - - ._ <br /> 45 contract work. <br /> I 46 <br /> 47 Section 1-08.9 is modified by adding the following: <br /> 48 <br /> I 49 For overruns in contract time occurring after the Physical Completion date, liquidated <br /> 50 damages shall be assessed at the rate of ten (10) percent of the amount computed <br /> 51 by the formula in this section until the actual Physical Completion date of all the <br /> 11152 contract work. <br /> 1 RIVERFRONT DEVELOPMENT NORTH WETLAND COMPLEX 67 <br />
